Keith: Sorry to disagree with you but Ed and Bob were in the wrong and I really cannot see any support. They admitted cutting the fence to get in, they admitted digging and knowing they were not supposed to, and a jury convicted them of the crime as charged. I understand that at the sentencing they told the Judge that they told the group at the Tyler show that metal detector enthusiasts must follow the Army Corps rules (which means to me they didn't) and that buttons they had previously collected from this site were donated to a local museum. If the argument earlier was that they didn't take anything and hadn't been there before, why an admission of previous collecting? Ed and Bob really got a gift when the Judge decided to drop two points from the sentensing guidelines from a 10 to an 8. 8 points gets 0 to 6 months jail time, 10 gets 6 to 12 months. Had the prosecutor been able to prove that they had indeed committed prior acts, they could have easily drew jail time even with the 8 point guideline. They committed the crime, they gotta do the time. Tell you what, it is the Ed and Bobs that really make it tough on the rest of us. And now you want $10,000.00 to appeal - no thanks!
