Hey Cap, right on! I went to the BLM meeting Monday night and the county ordinance meeting Tuesday afternoon. Harry Fry was at both, along with the BLM. On Tuesday, when it looked like the county was going to pass the new ordinance, Fry stood up and told us we better consult with government lawyers before we pass this ordinance because "they wern't going to stand by and have it shoved down their throats!" Many stood up and said, "How does it feel Harry?" The ordinance was passed in the next few minutes! This ordinance requires government agencies to consult with the county, first, when any action is to be taken against any of our citizens. A big 1 year in jail and up to $10,000.00 fine accompanied it! One step in the right direction. (The county should be your first line of defense against the feds. If your county is not a self rule county, take steps to make it so. There is a lot of information on the net about this procedure.) Next, we will incorporate into the ordinance wording like this, "Any action taken against any citizen of this county shall be acompanied by a line of "Constitutional Authority" to do so! Another step in the right direction. All you miners out there, keep these rules in mind when dealing with the FS/BLM. 1) Keep all the paperwork they send you. (If anything came to a court case against you, this paperwork is as good as golden bullets to show intent on their part. 2) Answer all paperwork in the alloted time. Send it registered mail. 3) Any contact with them needs to be recorded, (who, why, what, where, when, and how.) Keep names and use this contact in your next written letter back to them. Example - I talked to ranger Dunderhead on the 14 of January, he said .... . This will verify what you have put in your journal. It is good in a court of law. 4) DO NOT, repeat, DO NOT argue regulations with them. They have the right to make regulations. Instead KEEP IT SIMPLE and tell them, "I have "X" amound of dollars in the claim and equipment. If you continue with these regulations against me, this is a takings under Constitutional and case law and needs to be compensated for. (If you need case law, I'll send it to you.) The latest is Hage vs. USA. The FS tried and did put him and his ranch out of business. Now they have lost big time in the Federal Court of Claims. Final rule comes out in April or May. Pre-rulings indicate this case alone will set back the enviro-whackos 80 years. Things are starting to turn but we need lots of help to destroy a hundred years of whacko regulations. I got side tracked, back to the rules of engagement. You have just told them about the taking issue with your property. Next, tell them to bring their check book when they come. You may get letters telling you to cease whatever you are doing and get your equipment off public land. Do not do this. If you do they will come back and say, you volunteered to remove it and it will stand up that way in court. You need to respond after they take action. Sad but true. Whenever they mention public land, correct them! The land is NOT PUBLIC LAND any longer. It stopped being public land back in 1958. If the words PUBLIC LAND are used in court you will automatically lose your case, right or wrong. The lands are FEDERALLY ADMINISTERED LANDS and never forget it. All Federal Lands are split estate lands, a miner might own the mineral rights, a rancher might own grazing rights to the same ground, thus split estate Federal land. Public land has no such split estate deffinition. If Federal Administered Lands is not used, all rights go out the window. Bottom line with any dealings with the feds is this, "continue with the use of these regulations against me and you own (whatever it is) so bring your check book! Send the same letter each time, just change the stamp. This keeps it a takings issue. Take pictures of everything and note any offical who was there and what they said. Take pictures of them too. It's not agaianst the law. It is out in the public for all to see, they might not like it but so? I carry a small voice activated recorder with me at all times. Whenever I talk to anyone, I turn it on and keep a careful record. Stan
