Utilização de detectores de metais Use of metal detectors
1. É proibida a utilização de detectores de metais na pesquisa de objectos e artefactos relevantes para a história, para a arte, para a numismática ou para a arqueologia. The use of metal detectors in search of objects and artifacts relevant to the story, to art, for numismatic or archeology.
2. É igualmente proibida a utilização eo transporte de detectores de metais não licenciados para efeito de pesquisa em monumentos e sítios arqueológicos classificados ou em vias de classificação, nos termos da Lei n.º 13/85, de 6 de Julho. Artigo 2.º Article. 2
Licenciamento Licensing

Publicidade e comercialização Advertising and marketing
1. Em toda a publicidade relativa a detectores de metais é obrigatória a transcrição do artigo 1.º e das sanções previstas na presente lei, transcrição que deverá constar igualmente de documento a entregar ao comprador pelo comerciante no acto da venda. In all advertisements relating to metal detectors is mandatory article transcribed. 1 and the penalties provided for in this Law, transcription should also appear in the documents delivered to the buyer by the dealer at time of sale.
2. Deverá ser aplicada sobre a embalagem do produto uma advertência, em língua portuguesa, que assegure a fácil visibilidade. Should be applied on the packaging a warning, in English, which ensures easy visibility.

Fiscalização Surveillance
A fiscalização do cumprimento das disposições da presente lei compete ao organismo a quem cabe a protecção do património cultural, junto do qual poderão ser apresentadas queixas ou participações pela violação do disposto nesta lei. The enforcement of the provisions of this law is for the body entrusted with the protection of cultural heritage, from which a complaint may be or equity for violations of this law.
Artigo 5.º Article 5. º
Contra-ordenações Breaches
1. A violação do disposto nos artigos 1.º e 3.º da presente lei constitui contra-ordenação punível com coima de 500 000$00 a 1 000 000$00 e de 1 500 000$00 a 9 000 000$00, conforme seja praticada por pessoa singular ou colectiva, respectivamente. The violation of Articles 1. And 3. 1. Nos processos por contra-ordenações previstas no artigo anterior, podem ainda ser aplicadas sanções acessórias nos termos da lei geral: In proceedings for offenses under the preceding article, may still apply sanctions under the general law:
1. Perda do detector de metais utilizado na prática da contra-ordenação; Loss of metal detector used in the practice of the offense;
2. Perda dos bens de carácter arqueológico, histórico, artístico ou numismático eventualmente achados. Confiscation of property of an archaeological, historical, artistic or numismatic any findings.
2. Se a decisão condenatória definitiva proferida declarar a perda do equipamento ou dos bens a favor do Estado, compete ao membro do Governo responsável pela área da cultura determinar a respectiva afectação. If the sentence finally given to confiscate the equipment or property to the State, it is the member of government responsible for culture to determine their allocation.
Artigo 7.º Article 7. º
Competência Competence
1. A competência para a instrução dos processos de contra-ordenações é do organismo a quem cabe a protecção do património cultural ou à inspecção das actividades culturais, consoante a entidade que levantar o auto. Receitas Recipes

Entrada em vigor Entry into force
