Calif. woman's car repossessed with toddler inside

SAN JOSE, Calif. (AP) -- Police in California say a car dealer who repossessed a San Jose woman's Honda Accord left with something a bit more valuable: her 2-year-old son.

The child, Cyrus Lopez, was sleeping in the back of the car on Tuesday night when it was taken away because the boy's mother, Isabel Leuvano, was behind on her payments.

Leuvano says she was waiting for her daughter outside the running car when someone jumped in and drove off.

here, that is called kidnapping. he took a person away by force without consent

I agree, he should be tried and when found guilty should be sentenced to giving her car back for the stress and mental anguish he caused by kidnapping her child.

It's sad that the repo guy valued an inanimate object, the car, higher than a child.
However it was at night and he may not have known the child was asleep in the back seat.

it doesn't matter if it was at night, he's also required to check and make sure the VIN matches
the paperwork. I don't think he did

A sad story.
I wouldn't want to have the job of repossessing. And there must of been other belongings in the car. So they are stealing. What a crazy world we live in.

I agree. It's a sad story.
Some people eiither couldn't or wouldn't make the payment on a car to the owner and continued to make use of it instead of returning it.
Apparently the owner had trouble locating the car, to repo it, and sent someone not quite competent to retrieve it.

A bad situation all the way around.

...A registered owner of an auto is always allowed to remove their personal property from any vehicle that has been towed... unless the contents are being held for a criminal investigation. All that is necessary is to call and make an appointment to do so, with the impound yard, or the lien holder if they have it.

NOT a job I would want either!
All told, a bad deal we'll most likely be seeing more of...

Sounds to me like she was about as good at parenting as she is at paying for things that she wants. I'm just curious how "close" to the car she was when she was not in it. I for one am not going to defend this lady for not paying her bills, nor am I going to criticize the guy for repossessing his car. I would suppose that if she was right there at the car, that she would have told the guy that her kid was in there. There was no mention of that type of exchange. It is simple, if you can no longer make payments for something, take it back to the rightfull owner and don't put your kid in dangerous situations like this :-\..

I would have done the same thing as the car owner and seized the
moment opportunistically to retrieve my possessions after non-payment and non-return of goods.
I would also have been armed if it turned ugly. Many women hide
behind their gender and children to perpetrate violent acts.
I'm sure the common sense of the authorities will embolden him to do it again if needed.
Why employ a repo. when you can do it yourself.

There is a T-net member who is a repo-man but I can't say his name.
He will probably have some good comments to make about the law
and his own experiences.

Like GPURS I wonder how "close" she was as I've heard of women leaving their child in a car while they play the casino or turn a trick.

it depends on where she was at the time,
as to if it is partially her fault.
but I Sill blame him for not looking in the Back seat
it only takes a second.

I wonder if it is one of the cash for clunker repos
we all know are coming in mass amounts

perhaps she should have kept her old paid for
vehicle in the first place.

It's always disconcerting to me that MSM "news" is presented for it's shock value and we rarely get to see any of the real facts. As discussion has come up, or just my own interest in something presented, I've occasionally tried to search out more information, and even tried to get follow-up info on down the line on a number of stories, with little success. I guess that's what the court process is for. And I don't have much faith in that !
It would be ridiculous to use the word "hope".

Gosh would I hate to be on the wrong end of the stick and be subject to the court of popular opinion like we see in the news !
