Every state is different. In many cases even if the tracks are gone the railroad owns the right of way. Many old railroads were bought out by larger railroads that may still be in business. Up here in the north alot of old railroad beds are used in the Winter by snowmobilers. I guess my point is you should ask around in your area, maybe the town hall where you want to detect, and find out who actually owns the property you want to look into.
