It is just missing the copper plating, really common with the copper coated zinc cents.

LOL, U.s. Minted, would not exist in aluminum unless a trial coin,
and legality would depend of whether it was stolen.

As far as Counterfeit,

TITLE 18 > PART I > CHAPTER 25 > § 490 Minor coins
" Whoever falsely makes, forges, or counterfeits any coin in the resemblance or similitude of any of the one-cent and 5-cent coins minted at the mints of the United States; or
Whoever passes, utters, publishes, or sells, or brings into the United States, or possesses any such false, forged, or counterfeited coin, with intent to defraud any person, shall be fined under this title or imprisoned not more than three years, or both."

I was just pointing out it wasn't aluminum there were aluminum pennies made a very small amount cant remember what year and it is illegal to own one but not this penny
