As many of you are already aware, Senate Bill 670
(anti-suction dredging legislation) was overwhelmingly passed by
the California Senate several days ago. The bill will now go to the
California Assembly. Our staggering defeat in the Senate has placed
our lobbyists into a full regroup mode.

All of this legislative activity (which will affect future dredging
seasons) is happening under the darker cloud of ongoing litigation
against suction dredging (which could have an impact upon our present
season) in California. Our adversaries have filed a Motion asking
the Court to prevent the Department of Fish & Game "from spending
any funds allocated from the State of California's General Fund on
any activities which allow suction dredging to occur under the
Department's current regulations." This Motion will be heard by the
Court in less than 2 weeks!

We are fighting the biggest, hardest battles our industry has ever
faced. You guys have always been there to help in the past.

Now we need you more than ever!

I have explained all of the important details, which include updated
explanations from our lead attorney and main lobbyist; and I am now
asking for your help. This is all contained in our latest
Action Alert -- which can be found at:
http://www.goldgold.com/legal/670_actionalert-2.htm

We need your help on this more than ever. Thanks very much for
whatever you can do!

Sincerely,

Dave Mack, President
New 49'er Prospecting Association

The New 49er's, 27 Davis Road, Happy Camp, California 96039, USA

has this same thing not been hashed over before? unless somehow california government supercedes the FEDERAL government, it will get smashed down in federal court once again. its federal land, and they have allowed us to own the mining rights to it, plain and simple. the part i find to be a joke and very ironic, is these feigned "environmentalists", who have turned parks into parking lots for malls. they have done more damage that way than they could ever make up for with some B.S. legislation.

I think the bottom line is we are a small easy target that some politician is going to use as a "LOOK AT WHAT I DID",to most probably including her, they think dredging leaves the piles of rocks the old bucket line dredges did. There are a lot of people out of work right now, that are dredging to put food on there tables.I also think there is something to that they dont want us to do something they cant tax.....cant tax raw gold .....yet!!!!!

Do you really want to dredge in California? Are your rights worth fight for?

If your rights get taken away because no one stood up for them. Then standing up after their gone will get you nothing.

If you have nothing then nothing is what your fighting for according to legislators. Look at the past and figure that one out.

If it is worth your time and energy to bring back dredging to California, then I suggest joining PLP( Public Land for the People). It is an outdoors man legal team that will fight for your rights to keep public land public for your use. The organization cost thirty five dollars a year and your counted as a vote in a class action law suite against the state for taking your federal mining(prospecting) grant and denying your right to use it.

The state of California is trying to take a federal grant away from you. Please research the 1868 and 1872 mining Act and get with PLP to keep what is yours.

PLP2.org Public Land for the People.

The phrase use it or loose it is more true now than ever.

Seamus you mean the 1866 and 1872 mining laws. the 1866 mineral estate grant granted us Americans the locatable minerals from the domain.they are ours and we dont need a permit to locate/remove our property according to the 1866 MEG law. Hal Antony has a 6 hour DVD video explaining it to us. it is full of really good explainations about the law and the relationships to other mining laws! to me, it was well worth the cost of these DVDs.

That is the point that I was trying to make. My wording does not always make my ideas as clear as you stated. I do believe is was 1868 instead of 1866. If I am wrong then I will correct my dates.

I respect John's opinion. I don't have the same opinion because I think we just have more direct involvement then he does. I have a few friends that see it his way. I fight for the right to use all my mining skills and take every chance that I get to let the public know what mining is all about so that I can speak of mining(prospecting) ten years down the road and I won't hear, "Mining, what's that".

If one state shuts down prospecting, fishing and hunting, camping and hiking in the wilderness that the greenies will say,"Let's take this act on the road to the adjoining states". I am a conservationist at heart while I practice wise use of natural resources.

I think most of us are,we are just not radicals and have an idea of whats really going on.I heard reports that the Klammath river experienced a record run of Salmon last year?First time I have heard that. Also heard that it has been common knowledge that pesticide runoff in Oregon has caused sterilization of Salmon within a certain radius......remember as said "I heard",any truth to that?

i also respect Johns opinion and the wealth of info that he has and has experienced years before most of us got into this endevor of mining/prospecting. and i had reservations of MEG and what they were saying at first(i didnt know syndrom)untill i started listening and researching on my own. then i bought the 3 DVD set from Armadillo mining and veiwed the talk Hal had with that group. my impression of that talk is: holly cow, how did we get off the track so bad! just read the 1866 law as it is. Hals presentation is only from the written law! Hal gives only the written facts of the law. understanding how the words are used/twisted around in some laws can/is really confussing, unless you take the time to understand how they are using/twisting them around. im glad i bought this DVD!now i want to save all of his recorded shows to DVD so i can listen to what he says about the relationship of the 1866 law to the 1872 mining law and others! remeber the gubermit GRANTED the U.S. citizens the minerals! they are ours! and it says that we dont need a "stinking permit" to recover them! why would we need a permit to get something that is already ours??personnaly, i think this is to important to not research to its limit!

NEW LAWS GO INTO EFFECT EVERY DAY THAT WE HATE-SB670 ANYONE-AND WE DON'T GET TO PICK AND CHOOSE BECAUSE WE LIKED THE OLD ONE BETTER. Pure simple and easy as long as you realize that 1 simple fact. Now anyone can revert to a prewar time but don't make it legal-jus' a good way to pump peoples pockets and run carpetbaggers run-respect as alwas Russau--just not a agreement-but as we've agreed on a million differing things over the years ol' friend-it's no BFD to me-John

thanks for your comment John! you have been there done that with laws/regulations for years and have a indepth handel on these! but "i" need to see if we have overlooked something on the MEG issue! it seems to me that these socalled "representatives " of ours have a unique ability to scrambel words pertaing to whom ever they are talking to! you can neve get a correct/truthfull answer,or even anything from any of them! esspeccialy from the gubermint agencys people!!! they like to twist words around and mix facts and like mining claims, they like to add stuff over the top of other laws, even though they dont know what that law really says/means .it has been proven that wacogreenieenviromentalists are TELLING/DEMANDING that our socalled "representatives" do "their" bidding now that "they"have helped o get into office! now that fact alone tells me that something stinks in our gubermint! remeber, its "we the people that get involved" that get "their" way!
