    USFS Terror: USFS Steals Miner Dave's Personal Property
    Saturday, September 29th, 2012 - Continuing their ever-so-unlawful ways, employees of the United States Forest Service have apparently recently stolen the personal property of gold miner David Everist that was situated upon Everist's "Twin Cedar Placer" property on the Sturgis Fork of Carberry Creek in Josephine County, Oregon.
    The incident was reported by two local miners who had been periodically checking on Everist's personal property at Twin Cedars, which included two camp trailers which Everist called home. According to the report, on their way up Thompson Creek Road, the miners witnessed two United States Forest Service Law Enforcement vehicles escorting what was described as "a roll-back trailer" into the vicinity of the Sturgis Fork. Later in the day, the two miners did a routine check on Twin Cedars and discovered that both trailers and other items had been taken by USFS from Everist's property during the course of the day.
    It is assumed that Everist's property was transported out of Josephine County and into neighboring Jackson County where county law enforcement officials have not been critical of USFS's illegal behavior. At this time, it is believed that the Forest Service did not have a warrant to go on Twin Cedars and seize the property.
    Speaking by phone from a patented claim located above Sunny Valley, Everist stated that he was stunned that the Forest Service had taken his property from "Twin Cedars" considering the fact that he is still awaiting a final judgement on his most recent case involving the Forest Service. He remarked that he had not been notified of any plans by USFS to seize his property, nor does he believe that they had a warrant.
    "I don't own much, and once again, the Forest Service has stolen what little I do have. That means that even if I went back to Twin Cedars, I'd have no shelter this winter. I really can't stay where I'm at right now come winter because the snow can get 6 to 8 feet deep up here," Everist said, remarking about the remoteness and high elevation of the place he's currently staying. "Basically, they've made me homeless and taken my livlihood from me," Everist added.
    Everist had planned to go back down into a lower elevation come winter, and at the suggestion of local miners, was intending to go back to school to study mining law.
    "I don't know how I'm going to do it now," Everist said, "but my intention is to go to college and become an attorney. These judges won't let you submit any law unless you're part of their little club. I won't give up, so that means that I need to go to college, study law and become an attorney specializing in mining and trust law."
    Everist, who is known by miners everywhere as "Miner Dave", became well known after taking a stand against the U.S. Forest Service when they violated his rights.
    In the meantime, Everist intends to take local USFS to task over the theft of his property. "It might take years," Everist said, "but I won't stop until these people are in prison."

    we need to find a way to stop these thefts from these employess of ours!prosicution comes to mind! they commited a federal crime by stealing from a claim and stoping/interfereing with mining activitys!

    Authority seems to run rampant sometimes because they think they are too powerful to be bothered by such under funded insects and just ride it out waiting for the people they stomp on to run out of money and time.

    If this guy is wanting to study mining law perhaps as a mining community we all could give a little bit of our finds to help him on his cause.
    If every miner on the west coast gave even a dollar I know this guy could do exactly what he wants and NOT have to be homeless while he does it.

    Are there any such funds to help this guy go through school?

    If he does, he really should start in California, after a year of living in California he can get the Bog Fee waiver and only have to pay for books and equipment.

    Just a thought.

    This is not the first story I've read like this, can someone please explain to me how the USFS can go onto a land owners property and take any of his/her property?? I guess either I'm missing the bigger picture or not understanding? Is it illegal to some extent to mine on your own property? Do they not get the proper permits/paperwork?? There has to be some sort of legal standpoint for them to do this. If someone can in the simplest form explain this to me I'd really appreciate it.

    No, I believe there is a way to stop this from happening BUT people must get involved.

    For instance let us look at the football Refs strike and a bunch of bad calls made by the part time Refs. So many Fans called, wrote, emailed that the folks in power Had To do the right thing and get the professional Refs back out there.

    WE are Fans of prospecting so all of us need to be involved in taking care of this problem and end this nonsense! Another Item, we all need to get out and vote and take our neighbors with us as ALL Legal Citizens of this country Must Get Out And Vote and I do mean this year! Any Government that is not constantly monitored by the people and for the people goes bad. IMHO, we've arrived there and now we must get involved and stay involved. Rome was not built in a day but it fell pretty fast in comparison.......63bkpkr

    This is so true.

    There are so many thousands upon thousands of prospectors out there from doing it for fun to Full time income.
    If every single one of us donated just a couple bucks every once in a while we could make a Super Strong Group and have full time, paid reps and legal reps.
    It could be like a Gold Miners Union.

    How crazy and awesome at the same time would that be?
    It would be like the biggest club ever, every other prospecting club could join in and we could fight as a whole instead one by one each time one of us is smashed under their feet.

    Big Idea's like this could work, we just have to get the right minds in the game.

    these wacoenviromentalists start their rein of terror with the public! they feed on the publics not knowing whats really going on with small scale miners. then it flairs up from there. once they have enough public spoon fed with enviromental lies then the public hits the socalled "representatives" of ours with their complaints. and politions thrive on public support/votes. so theres where we, as a group need to be pointed. YEP! get involved or get left out!and thats where we are today!

    i just sent a email along with a copy of that story to Josephine County Sheriff the sheriff he will stand with the miners and public. he has been fighting against the USFS. he is for the people and for us miners. i have sent him a lot of info over the yrs to help him in the fight against the usfs. what the usfs did to Miner Dave was illigle and then taking his eq to Jackson County whas also illigale they were transporting stolen goods acrose county lines. so lets see what we can do to help get MINER DAVES eq back.

    Why is the forest service spending absolutely any time or resources on this when they should be out there busting massive Mexican drug cartel growing operations that go on in these very forests!! It's like when the cops spend their time handing out tickets to towns people while thise peoples houses are being robbed!! Priorities people priorities!! A lot bigger fish to fry than small time and hobby prospectors!!

    It depends on the agenda. I used to believe they were indifferent. As long as we were respectful and followed a few basic rules they didn't bother with us.

    Now it is more like we are the biggest problem or threat to the forest. The trashers seem to get a free pass. We get threatened or as in this case have our equipment confiscated.

    the USFS/BLM goes after the miners because we the person that has their name on the claime and they say that your the ones leaveing the mess, when its these freeloading jerks/greenies/wacoenviromentalists that are causeing the trouble and letting us take the blaime while they sit back and laugh about it!
