Is my thinking correct in in saying- that is all well and good for navigable waters flowing thru state owned property but his claim is within the National Forest which is owned collectively by the American People, thru the Feds, not the state. There new argument is sure to bring up several new questions as to land use of National Wild and Scenic Rivers.

Crap, if you follow their logic they are basically saying our rights under the constitution end where the state begins.

They do impose their power over the states on immigration issues though or when ever they see fit if it meets their needs.

The public trust doctrine is only an easement for boating and recreation, isn't it?
http://www.dbw.ca.gov/PDF/PublicTrustDoctrine.pdf

Brandon’s claim is up the Feather River, <edit> its a small tributary --south branch Middle fork feather river in the National Forest
the Feather River is considered a navigable river from the mouth to the RR bridge at Marysville 28 miles.

The judge should say enough is enough you had your chance. Now your mocking the intelligence of the court by introducing poorly researched arguments that have little or no merit to the case. It's obvious they are throwing sh-t out there to prolong the case and see if they can get something to stick.

I heard a wannabe politician the other day say "I am a non violent revolutionary socialist". The problem with this quote is when free peoples rights are taken away they tend to get violent. Not advocating, just saying.

my claim is on a tributary to the Middle Fork, not navigable!

Navigable or not the central issue is that the greenies want the court to declare that the United States does not own the lands below the stream. No minerals, no water no ownership.

Idiots

From the founding Congressional Act creating California as a State in 1850:
An Act for the admission of the State of California into the Union.

SEC. 3. And be it further enacted, That the said State of California is admitted into the Union upon the express condition that the people of said State, through their legislature or otherwise, shall never interfere with the primary disposal of the public lands within its limits, and shall pass no law and do no act whereby the title of the United States to, and right to dispose of, the same shall be impaired or questioned ; and that they shall never lay any tax or assessment of any description whatsoever upon the public domain of the United States

Desperate idiots.

I Hope the court doesn't waste any time on this nonsense.
