The U.S. Forest Service criminally prosecuted a small-scale miner, John Godfrey, in The District Court For The Eastern District of California ,
for hand mining with the use of a sluice box. The New 49'ers Legal Fund has filed an Amicus Brief in the appeal.
We believe the government and magistrate made a serious error by not allowing proper consideration to the Section 228 regulations which expressly state that hand mining and sluicing is completely exempt from the requirement to provide any Notice or Plan to the USFS

I talked to a friend about this. he said what they did in his statell was invited all the state counselors, senator, of every city and so on to a weekend of prospecting on there groups claim. Not all of them came but the ones that did really helped end the BS and get things to the way they should be. it helped show the people who have no real idea what it does to the river or anything else when respectful miners go out and have fun. cause allot of these people are lawyer and all they have to go by is here say. so they have nothing Judge the situation by except what they've heard from all the super tree hugers. this gave them a real prospective. So it might be a good idea to do the same thing out there.
