As soon as I heard about the Oregon decision I had a feeling that something like this was going to happen. Since the Oregon decision has not been published (yet), that the State of California has attempted to site it tells me that they're getting desperate. I seem to remember that weather or not a decision has been published will determine if it can be used as ammo in another case. I also seem to remember that Brandon ran into some snags when the state requested that Judge Ochoas' decision be removed from publication. (Not sure if I'm remembering or saying that quite right or not. ) It seems to me that the State of California wants to have it's cake and eat it too!
