The US Supreme Court ruled in favor of of the peat miners on the CWA yesterday!!! Pacific Legal Foundation took the case (same ones who wrote the amicus for Rinehart). https://www.yahoo.com/news/supreme-court-gives-property-owners-162100770.html?ref=gs&soc_src=mail&soc_trk=ma
This will have carry over for us gold miners, I hope the OR guys saw this since their issue is mostly clean water (the CA stuff is more focused on ESA but has morphed into clean water also),

To get something heard you have to proceed without a permit and get caught and ague a permit is not required
or apply for a permit then challenge the permit. sounds familiar...
seems like common sense to not have to go to such extremes just to have your case heard in court.
