I am not concerned with this petition as I am not an American citizen but let me just tell you how I see beach hunting in the US from my computer watching youtube: I am amazed by the number of detectorist in the middle of the afternoon detecting between towels and people swimming in the wades.

I'm a detectorist addict but only detects at night time on the beaches, for wadding only in the morning when everybody is sleeping or at the end of the day before the sun goes down. I can understand that people feel bothered by metal detecting around them in the middle of the day. It like smoking in a theater or in the subway at the rush hour.

A better understanding of your environnement and people feeling would have probably avoid those conflicts.

I feel the same about intruding on a person's space so I'll stay 20 feet away but I'm there to do my sport like the surfers, kite surfers and Little kid with a shovel & bucket!
So if low tide says Minus Tide I'm there regardless who is on the beach and in the water.
Always respect the other person's space. I learned that while surfing.

Government are voting the law in favor of the votes (most of the time). Trust me, seen from a very different country and mentality, beach hunting is the US in the middle of the afternoon during rush hour won't be tolerate in an other country.

To give you an exemple, metal detects in August à 3PM on the beach, even if you are far from everyone : you will find your car scratched by everyone.

I think Law in a way can be seen like a contract between to companies doing business : when you start to re-read the contract... business is dead :-(

More often than not our government does not vote in favor of what the people want, as case after case prove. This is America "land of the free" we however are losing our freedoms rapidly because many people cower to the government, a very dangerous road to go down. If people in your country would scratch someone's car for detecting it sounds like the people there have no respect for the law anyways as I'm sure that vandalism is a crime. Am I not seeing your point correctly?

In Europe, the law is not seen like it is in the US, it's not ON/OFF in a certain way, i know it's hard to understand for US citizen but we are used to "self discipline" and what can be admitted by the surrounding and what cannot, even if you have the law on your side. At the end of the day you need to live and be accepted by your surrounding EVEN if you think you have the law with you.

Where I live, metal detection is prohibited (not the metal detection, but the finds with the usage of a metal detector are illigal...). I detect a lot without any problem, because I respect people sensibility and feelings. I have been cought numerous time by Police without any futher action.

It this case, Law is the tool to prevent mass metal detecting bothering everyone. If you bother no one, then the law is not applied!

PS: sorry for my english, it's not my everyday language :notworthy:

I understand about the English, that's cool. Seriously though this is not coming about because people are being bothered/harassed by metal detectors. This is about a few elites who think they along with the government have a right to take away another freedom. Lots of laws are not strictly enforced here (immigration is a great example), but the last thing we need is more laws. Massachusetts is a very controlling, over taxed state, once something like this passes there other states will follow suit. The dredging ban in California is a good example, following that law even maine the state I live in banned gold dredging. There is so little gold here I bet there aren't even five dredges in the entire state! This is about power hungry government plain and simple.

P.S. Why are finds found with a detector illegal? I'm guessing because your government claims all rights and ownership of them? Just curious.

it is forbidden to hunt on historical sites, and historical sites are not published....

Each time you build a new house, 98% of the time you have the visit of archeologist blocking your construction for at least 6 month because you always have something old under your foot.

Even if you find something on a place witch is not an historical site, by the magic of bureaucraty the site has been declared Historical site the day before your find: you go to jail, advertise your face on the news and they keep the finds.

It has nothing to do with taxes, its a mixture of jalousy and nation vs individual (socialism). So the coins should remain in the soil and detroyed by the pollution, constructions and farmers rather then beiing saved by detectorists.

So everyone is metal detecting and keep everything for them and just shut up. UK is the only example where the state have tried to take advantage of Metal Detection hobby.

Yup, sounds like the government has it rigged against the citizens. I would be very quiet about my finds to in that case. This is the kind of situation we don't want to have happen here with our government. A government afraid of the citizens is an honest and fair government. A government whose citizens are afraid of the government has endless power and corruption...

Signed and told them they needed to ban people sunning themselves on the beach - a proven health risk (and often a real eye sore). However, I must admit that I still suffer from a bad shoulder from digging about 80-90 coins on New Smyrna Beach all buried about 11-13" in wet sand. Perhaps in Mass they're trying to protect me from myself - my known worst enemy. Out of my cold dead hands...

Here's a question for all of you who are ruled by the laws of other men. What facts do you have that their laws apply to you?

Believe it or not, if you are charged with a crime, this is one of the elements that must be proven, not assumed before you can be charged. So let them pass their silly laws and when they want to attack you or me, just demand the proof that the law applies to us. It's called a Brady motion if you must know.

I'm in and it's signed. What do they want to do next. Permits?? I can see regulating permits on different areas. But this much go. I guess it must be to much extra work on the rec dept.
