Found this old toy soldier in an open lot next to a house from the 1920's. was thinking it is possibly world war 1 any input would be greatly appreciated!

Nice find. Could well be, to my untrained eye.
It's hard to say as I can't make out the detail too well on your photo, but to me, it's reminiscent of soldiers produced by a 1920's/30's casting kit as shown in this eBay listing:

It looks like yours might not be wearing the leggings, but a lot of the other details are consistent. Would explain the red paint, too, as the person who cast them probably then just painted them in a solid colour - whatever they happened to have.
