Hi all,This mit happen too you and is a positive for Mder's.There few people out there,that lay claim to land that is infact not theirs.A fence should be placed on the correct bountry by law and the local panning authority will have a copy of the deed of the properity.Both by title and size.I found a few of these sort of landowners that put up fences that not legal or are deemed their properity.Not sure if they cannot measure or they are just stealing land for their own use.In todays case the site i went too i had premission from the owner[ not]. The site is a leveled ground cut into a hill and is about the same size of sports ground.The day was bit slow and there was much to be found.

Untill i noticed a shallow depression about 40 feet away.walked over and the Md screamed back at me.That was a huge signal and real shallow.Cleaned away about an inch of dirt and found a large Government Survey Marker. ??? ??? ???.These marker there put here in 1957 and are still used to this day.Seems this land owner was not the owner at all. >:( >:( >:(.

I went home and checked the 2006 data on public land in my local area and sure enough more than 50 % of the land at this site is "UNRESERVED PUBLIC  LAND".There was not record of sale of this land to the owner.
With no understanding why this person lays claim to something that not his.

Well poor MDer's have to obey the law so what about these sort of land owners. ??? ???

I went back to see owner [not]after i finished part of the site and i just couldn,t help myself. ;D ;D Yes i asked what was the story about the claim to the land.Just got a load of B.S, so i asked him to take a look at what i found.He just didn,t want to know and go a bit rude.well alot rude and raved on about no-thing.The site is large and i have covered little of it and next time i go there,i,m not asking premission either and this crook can do nothing about it. ;D ;D ;D

A story like this is not unique to Oz alone, heheheh! Just recently I found out about a landowner here in our city who had pasture by the river, on an inside bend. As the river eroded out the outer bank, it changed course year by year. Each year when the inside bend of dry land got larger and larger, he merely moved his fenceposts to stay the same distance from the river as it was going further and further from his house, LOL! ;)

there is also laws called squatters rights you may want to read about

"squatters rights" donot apply to land that is classed as "Unreserved".this means on-one person or group can soley use for their purpose.Unless the local authorities reclass to "reserve" or "sell" the deed [title]  Which i did check out.

My land plat tells me my property gos to the center of our creek that borders the back of the property.
If the creek moves so does my property for the good or bad.

Well you can say what you like,but if he calls the police on you for trespassing,they will tell you to leave and that you will have to deal with it in court.At least with his permission you can say he told you he owned it .
Also,the mark on the marker just before the 5.0 looks like the mark for english pounds.???
So even if he doesnt and you think he is acting like a jerk i would still be careful about not having permission.

The pic doesn't show a fence on either side of the survey marker boundary. Is there a fence enclosing the marker?

Thanks for the reply. First yes the pound stirling[australian} was used in australia until 1966 and then decimal  currenty.this survey marker was put in location by the local planning Authority and these markers appear about 30 yards a crosss the whole  town.they are set in concrete so they don,t get removed.The person uses the block for parking when there is major events at the show grounds up the road.He charges people and pockets the money.
he has no right to do this and is dishonest.Simple i can and will use this public block when i like.If he wants to ring the cops, he will be giving himself up.The Law is Law. He's scammer and i only found out when i found the marker.I am not going to say anything to the authorities, I just want to my hobbie in peace.
The block has a 4foot high mess-lock fence below the site cut and the final side the enmarkment is to steep for most to walk up or drive up.
