AT Max will work fine on the dry sand but it will not do well in wet salt sand or in saltwater. If it is a freshwater beach it will work fine in the water or wet sand. It is a single frequency VLF machine and only pulse induction or multi frequency VLF machines work well in a salt environment. You don't say where you are so nobody can tell you if it is legal or not where you intend to go. If you have seen others doing it it is probably legal. In New York it is legal but you need a permit to hunt beaches and NYC parks, I think the NY permit is twenty bucks. Good luck and find some cool stuff, and welcome to the site. Just bought my Garrett AT Max. Going to play with the settings this winter and get out this spring into East Tennessee.

On the concerns about legality, check with the local governments for sure. If it is a Federal beach ( National Park or National Forest ) no it is not legal. There is no metal detecting on Federal lands. But mainly it depends on state and local laws so make sure you check. Here in Tennessee it varies from county to county.
