Curious Question - Military Related

I don't know the answer to this but perhaps one or more of you do;

Prior to the division of the states that lead to the civil war, if I held military commission with the United States would have to resign my commission prior to enlisting with the south in order to avoid potential charges of treason? I mean, how did that work once things became divided?

THAT is CORRECT; Capt. Robert E. Lee, US Army; RESIGNED his US "COMMISSION"... becoming Gen. Robert E. Lee, CSA. Lee was CAPTAIN of the US Army in the Mexican War. NO saloon...
