It is pretty reasonable to assume they are going to base their determination on something that doesn't matter or make any sense...so, not to far fetched really.

Sounds like the fear here is that they will base their decision on the actions of one guy and make it illegal for everyone that has a legal right to sluice now to do what he was doing , even though what that one guy was doing is already illegal.

That's a healthy kind of fear to have when dealing with regulators IMO.
