Judge to decide on toilet swearer's fate

A judge is set to reach a decision in the case of a woman put on trial for swearing at her own toilet.
Dawn Herb, 33, was cited for disorderly conduct after her neighbor, an off-duty police officer, called authorities to complain about her potty mouth. Herb pleaded innocent and went on trial on Monday in Scranton, Pennsylvania.

A court victory for a woman from Scranton and freedom of speech.
A judge in Lackawanna County found Dawn Herb not guilty of disorderly conduct. She is the woman who was overhead swearing loudly at her overflowing toilet inside her home. She was arrested and charged with disorderly conduct.
However, the district judge ruled that Herb was not guilty, saying even though the comments may have been vulgar they are still protected by the First Amendment.
