found a pre 1769 unlisted wreck - trying to "claim" it wish me luck

while doing some local area research, I found an old shipwreak site on a pair of maps an english one dated 1769 and the other a copy of the 1769 map in "french" dated 1778, so I checked with the state of florida -- they said they had no "listed" wrecks from that time frame in that area--- so it was not a found or "listed" as claimed wreak -- however since its in a "protected zone" the normal get a piece of wreakage or cargo as "proof" cannot be done--so when they asked me what proof do you have that it exist then?--I replied (2) historical maps from 1769 and 1778 showing its exact spot --they sputtered can you show us to back your claim? I said sure I'll sent you a copy of em--so off they went along with a copy of my nautical science degree and a letter stating that I was "claiming" the open wrecksite. wish me luck --gonna need it I think--

this "protected zone" its not a underwater archaeological site is it? if so you might have real problems. read the link posted below and it might give you some insite. if nothing else its good reading about cannon theft in st. auguestine.

Well if it's in florida, out to three miles off shore you must plunk down a $6,000 deposiy and pay a $500.00 fee and then they get 20% of whatever you find plus what the feds get..subtract what it costs to actually find and recover....anything at all left over after these blood suckers get through you can keep. if your lucky you might be able to buy a case of beer.

sorry -- talked with the state of fla to claim "discovery" of the wrecksite and to get rolling on getting permits for recovery of the site -- they said that they do not have a wreck recorded according to the states "master file" at the wrecksite that I told them of --and that my research was sound and valid --- however they said due to its "location" -----in a aquatic preserve zone area---that no "for profit" recovery type permits would be issued to go after it as it might disturb the area or the local marine life yada yada yada -- (but the sand dredgers digging at the other end of the island to "renourish" the local beaches are in the exact same aquatic preserve zone (just at the northern rather than southern end of the island)-- they are are ok with the sand dredgers moving sand around and stirring things up but not treasure hunters eh? ---(moving sand is moving sand and both of the areas fall under the same "aquatic preserve zone " --- its ok for the sand dredgers to do it , but not for me? hummm-- that seems a bit odd to me --- plus the state said if I want to just do "research" on the wreck with university types that it could possibily be "arranged" ( oh ya --in that "set up" the state and university get all the goods and I "the finder" get zippo other than "credit" for the find --- like I'm "going" for that)--- hell I can't spend "credit for the find "--- show me the money !!!! --- seems like I'll have to wind up having to get a lawyer to get what should be rightfully mine (odd thing that most politicians are lawyers before and after being in "office" )--- lord, stuff like this is why I hate dealing with govt folks these days ---

the really funny thing is the state of fla archies had a copy of my 1769 map upon which I "found" my wreck in their archives and had it for "years" -- of course they never paid any mind to it till I showed em my copy of it and "pointed" the wreck site out to them --- lord , I ask you to give me the strength to bare this ordeal and see my plans thru ---

and they wonder why folks go "pirate" rather than "deal" with them -- humm wonder why? ---- but I go by the "law" and I plan to get mine legally cleared "upfront" ---- that way they can't try to "take" anything from me after I've done all the work by saying it wasn't done legally or properly --- like the way the govt folks tried to screw mel fisher long ago (happily mel took em to court and whipped em good --- god bless his soul)---

as bob marx says wizely ---treasure is trouble --(because once you "find " treasure theres everybody and his brother trying to get their mitts on it -- just like days of old --treasure brings the pirates a running) --- Ivan

Sorry to hear that. Does it look like they might get their "friends" to salvage the site and since you reminded them of it you don't get any credit????????

nope the sites a no go -- I will not "release my claim" as finder of the wreck -- if it gets dove --I get credit for the find and a cut of what comes up or I sue the living hell out whoevers fool enough to do it -- in the meanwhile I'm looking for a legal way to crowbar my way in to get "recovery " permits --- was told research permits could be issued but what the hell good is research permits -- if recovery permits are a no go ? -- "pay" for all the research to see if the boats worth while? and then later get turned away when its "goodie" and $$$ recovery time --- ya right like thats going to happen --- Ivan

Looks like you just did all their work for them and was NEVER going to get recognition let alone a claim all the time you have the proverbial hole ;D

If you want my advise play ALL inland detecting by the book and respect that ALL land belongs to somebody so seek permission and declare ALL your finds

However here in England do as i do ;D

I spit in the eye of private Beaches because shore land from high tide to low tide is owned by the Crown (which is you and me anyway as they are just our servants ) and then up to 1 mile out to sea comes under Maritime laws (which there are none until the coins of the realm are mentioned), then after that who knows until you reach foreign waters

So in a nutshell once you leave dry land everything is fair game unless of course you choose to trace the owner of a lost ring etc :-X

Items lost at sea that get washed up such as the recent Devon Napoli wreck, should be reported and a finders form filled out giving the owner 30 days to reclaim it, if they do then you can charge them a finders cum storage fee, but none will reclaim as the insurance will of paid them out and they certainly wont want it back ::)
A good rule of thumb is if theres still a crew aboard go find another wreck ;D

So unless its a protected wreck i fart in their general direction :) :) ;)
