Mineral rights question

Have found a 40 acre parcel of land in northern NV. that
is being sold with 25% of its mineral rights.
The realtor can not answer this for me, so here goes.
Can I metal detect, drywash- on slightly a larger scale then
the average (using a small back hoe), etc.
Has anyone any info. on how much I can do, without causing
a problem to the 75% owner ???? Maybe dig to a certain depth !!

Howdy golden ray,

I haven't bothered to check the laws in NV., but here in Texas, mineral rights are mostly just for oil, gas, and uranium. The surface owner owns the water, gravel (no matter how deep), and even gold. I would say dig away, you just have to call before you dig, it's the law. This is just to make sure you don't dig into a pipeline, or buried cables.

Thanks Homar, the state of NV. has water rights also. 1800 gallons a day is the max. you can
use without buying 'more rights' Not concerned with buried pipe lines. This is gold country, with
small & large mining operations everywhere. Will have to check with the county recorders office
next week.
