I have had correspondences with the head of a Texas park concerning metal detecting on park/army corps land. Hopefully with ongoing conversations we can get a compromise or some amendment to laws concerning detecting in Texas State parks.

Mark -

We are still in the negotiation phase with the US Army Corps of Engineers
(USACE) with the Eisenhower State Park lease.? You are correct in the respect
that our lease expired in 2004 but there is a legal clause that permits us to
continue to operate in the same arrangement as the previous lease until our
lease is renewed.? Regardless of the lease arrangements, State Park Laws and
Park Rules and Regulations apply on all Texas State Park lands.? This is what my
staff told you about when you were metal detecting on the park beach.
Basically, if the USACE has a provision that permits an activity but there is a
state law or park rule and regulation that restricts something in the State
Parks, we enforce that state law or park rule and regulation.? Hope this helps
to understand where we are coming from.

I have a good contact with our local USACE office.? I will forward this info
over to him and will send any info back to you concerning metal detecting on
their land.

Thanks for your concerns...

Paul Kisel, Park Superintendent
Eisenhower State Park Complex
