Sorry I think this is a post CW button. The backmark will tell the tale, please let us know what that is. From initial glance, it looks more like the postwar state buttons (rim and back construction) from the 1870s...still a nice find. Heck I find more CW buttons than I do Indian War era.

We cannot time-date your cuff-size 3-piece New York State Militia button with absolute certainty without knowing exactly what its backmark says. However, it is "most likely" from the civil war era, because after the war the size of the encircling rim was widened on many of that type of NY button, and yours has the "narrow" version of rim. Compare it with the ones in the photo below.
Wide rim is #12,
narrow rim is #13,
super-wide rim is #14.

Please note, I said "most likely" because some of the post-civil-war NY State Militia 3-piece buttons were still made with a narrow rim. We need to know the backmark for certainty.
