Fellow CRH'er??? Nah, would have waited for a $2500.00 medical bill...

So I read this article in the local news tonight. I figured a few here would appreciate it. I guess some do not appreciate the opportunity to sort some pennies like we do... lol. I will try my best to post this story:

POLICE CITE VERNAL MAN ACCUSED OF PAYING BILL WITH 2,500 PENNIES.

VERNAL — A Vernal man has been charged with disorderly conduct after police say he caused alarm when he paid for a disputed medical bill in pennies.


On May 27, A Man went to Basin Clinic prepared to dispute an outstanding bill, according to Assistant Vernal Police Chief Keith Campbell. The Man, 38, apparently did not believe he owed the clinic the $25 it said he did.
“After asking if they accepted cash, The Man dumped 2,500 pennies onto the counter and demanded that they count it,” Campbell said. “The pennies were strewn about the counter and the floor.”
The incident upset clinic staff, said Campbell, adding that The Man's behavior served "no legitimate purpose."
Clinic staff told The Man they were calling police and he left the office. Officers caught up with Him later and issued him a citation for disorderly conduct, an infraction, which carries a potential fine of $140.
The case will be heard in Vernal City Justice Court.


I seriosly think this is awesome, outside of the fact that it was only a $25 bill (Something like this should be used on a much more expensive bill). IMO Hard for me to imagine getting a ticket for paying with legal tender. The next question I have is... How is he going to pay the fine he gets? I think some dump halves would be fitting "loose of course".

Well, I hope they did at least count his bill as paid for. I don't see how that can be a chargeable crime out here in California because officer cannot charge someone for an infraction not committed in their presence. It would have to be a citizens arrest by the staffers at the facility in order for him to be charged at all.

I hate medical bills mostly because they overcharge them like a legalized scam. However $25 would be nothing.

There have been posts regarding this issue before and there were many posts from people alot more knowledgable than me on the subject but from whatmost were posting, business have every right to not accept certain types of currency regardless if they are legal tender or not. However, some posted this was only for private business and did not apply to government agencies.

Based on the above video, it seems that they have the legal right to refuse it also. What I don't get is why someone who has a legitimite bill would want to try and stick it to someone by dumping all the coins. The YouTube video - the guy was a swamper and thought parking laws did not apply to him and racked up $300 in fines. Yet the reception this guy gets is not of his inability to follow the rules we all follow but rather one of "yeah!! Stick it to the man!!"

I think its fine to pay with whatever you want but no reason to dump them all over the desk like a mountain.

Just bring them in a sack or barrel depending on how much the bill is. I think what got the guy in trouble is just spraying them all over the place like a madman lol...

I did a similar thing in Jr high . Yes way back when (23 years ago+) . The teacher said I had damaged a math book for a total of $18.32. I have no idea how they came up with that number. It was already damaged when I got it. So I brought in 18.32 in Penny's to pay for it . I dumped them all over her desk. She threw a fit and I got sent to detention. - Only time in detention but way worth it.

Yessss...theres one on youtube of a guy that has his car towed and pays the towing company $80.00 in pennies. Cops are called, and towing co is forced to accept it as payment because it is "legal tender". I guess it helps that the cops that showed up hated towing companies lol.

From what I understand (I may be wrong) stores and businesses have every right to ask for whatever as payment, and can accept or refuse whatever. But when a company bills you, for a debt, such as a medical bill, in US dollars, they cannot sue you for non-payment if you have paid in legal tender, unless you have agreed to pay in certain bills/coins (for example, when you agreed to a medical procedure, they could have said you cannot pay in pennies, but if they haven't done that and billed you in US dollars, you cannot be sued for non-payment if you pay in legal tender). However, when you buy something from a store, they can demand payment in whatever before they hand over the item.

Yea, it's the legal difference between a mutually agreed upon transaction (immediate purchase) vs being billed for a demand of payment. Mutuallly agreed upon transactions are negotiated in real-time and the seller can refuse your terms in advance of accepting payment. Demands for payment of a debt are not considered mutually agreed upon transactions, unless there has been a prior contract for payment executed, detailing how payment must be made.

When offering payment in any form of legal tender for a demand of payment, if a biller refuses to accept a billee's form of legal tender, OR the amount of payment offered. There are many legal precedents in civil law. The courts in most civil jurisdictions have ruled that a biller has forfeighted the right to further action against a billee by refusing to accept that billee's offered payment, in full OR in part. Most examples of this in case law are medical or hospital bills whereas a biller has refused a partial payment from a billee. They must accept any legal tender payment offered, and if the terms of payment are not satisfactory, then seek remedy in civil court. By refusing to accept payment, they risk the court ruling against them.

I helped a local fellow I know with a case of this sort that had gone to a local hospital emergency room in 2009. He was sent a demand for payment for over $5,000, which he felt was way overcharged, so he asked me what he should do. I advised him to just make monthly payments of $25, and to keep all receipts and documentation from them. He was concerned about giving them a check or credit card number out of fear that they might try to overbill for more. Per my advice, he drove to the hospital in person and made these payments in cash once a month. The hospital accepted payment like this for 4 months, then refused to take any more payments unless he met a new "minimum" payment amount of $100/month. I advised him to document their refusal to accept payment by demanding that they put it in writing, which they did. Per my advice, he kept attempting to pay the $25 per month, and they continued to refuse to accept his payment. The hospital turned it over to a collection agency, then a lawyer. The lawyer sent him notice via certified mail that he must make payments directly to the lawyers office at $100/month or he would be sued. I advised him not to respond to the lawyer, but to keep offering the $25 a month directly to the hospital, and to document the refusals by having the hospital put it in writing each and every time. On behalf of the hospital, the lawyer filed suit against him in the local courthouse. The court ruled this year that he had made payments and payment attempts in good faith, and that the hospital had acted in bad faith by refusing his further payment attempts. Not only did the court rule in his favor, but also ordered that the hospital had to pay all legal expenses and court costs. The original debt was discharged, and the hospital had to pay to correct the damage done to his credit score.

I don't think he should have gotten in trouble at all. Yes, he should have probably had them rolled, or in a bag for them. But giving him a ticket for disorderly conduct?? First off, no one is ever happy to pay medical bills. 2nd, pennies are legal tender. If he would have gone in there and only owed $5 dollars and paid all in pennies this never would have even been an issue.

Ha Ha Ha, this story is national news now. I just noticed it is on yahoo.com Oh man, I sure wonder about the media. Wouldn't it be nice if they were to actually report on something that "matters"? This story would have been so much better if it were a $250.00 bill, or anything over, It seems so petty to me... I hope the judge lets this guy off.
