In September, New York Police officers responded to an emotionally disturbed man causing a ruckus at a Times Square bus terminal by opening fire on him while they were surrounded by crowds and traffic. They missed him and hit two innocent bystanders (one of whom was in a walker). Police said at the time they thought the man, Glenn Broadnax, was reaching for a gun, but he turned out to be unarmed.

Even though Broadnax was not armed, an indictment unsealed Wednesday is charging him with assault for the injuries caused by police gunfire.

The man, Glenn Broadnax, 35, of Brooklyn, created a disturbance on Sept. 14, wading into traffic at 42nd Street and Eighth Avenue and throwing himself into the path of oncoming cars.

A curious crowd grew. Police officers arrived and tried to corral Mr. Broadnax, a 250-pound man. When he reached into his pants pocket, two officers, who, the police said, thought he was pulling a gun, opened fire, missing Mr. Broadnax, but hitting two nearby women. Finally, a police sergeant knocked Mr. Broadnax down with a Taser. …

Initially Mr. Broadnax was arrested on misdemeanor charges of menacing, drug possession and resisting arrest. But the Manhattan district attorney’s office persuaded a grand jury to charge Mr. Broadnax with assault, a felony carrying a maximum sentence of 25 years. Specifically, the nine-count indictment unsealed on Wednesday said Mr. Broadnax “recklessly engaged in conduct which created a grave risk of death.”

“The defendant is the one that created the situation that injured innocent bystanders,” said an assistant district attorney, Shannon Lucey.

Broadnax was taken to Bellevue Hospital after they got him down and told police he was hearing voices of dead relatives and was trying to commit suicide. But a psychologist has nevertheless found him competent to stand trial.

One of the women shot by the police is absolutely not having it:

Mariann Wang, a lawyer representing Sahar Khoshakhlagh, one of the women who was wounded, said the district attorney should be pursuing charges against the two officers who fired their weapons in a crowd, not against Mr. Broadnax. “It’s an incredibly unfortunate use of prosecutorial discretion to be prosecuting a man who didn’t even injure my client,” she said. “It’s the police who injured my client.”

New York City spends hundreds of millions of dollars every year settling claims against the city (though not all are tied to police behavior). Despite trying to redirect responsibility Broadnax’s way, it should not be a surprise to see six figures or more of city money heading in the direction of Khoshakhlagh and the other woman shot.
 

NY is a police state, they only want police to have firearms...

Deer hunters have to positively ID their target before pulling the trigger but the NYPD dosn't. Go figure. And the worst part is there will be someone along shortly to make excuses why this is ok...

I am with TH and TAZ! We cannot allow dictatorial leadership to gain any more ground against the rights of American citizens! Stop the gun grab now!!!!!
 

Take heart my friends. Good news is coming. Truly seems like New Yorkers in record numbers are moving here to Texas. They are everywhere. Sort of like the Oregon Trail, but with Caddy's...

I remember the old days, before the migrations into New Mexico (someone found out it was scenic, or artistic, or quaint, I also remember Austin before it was overrun.

They are running from the bad ideas and miscalculations in leadership that caused the destruction of their home states and towns. They do not learn from experience though,, and they are bringing destruction to you!

YES! I see it happening already here. Especially the ones who move here from Kalifornia. Like a cancer leftist ideology grows wherever it goes!

Winner winner, chicken dinner ! I was born in New Hampshire in the 50s and lived there most of my entire life. It was an awsome place to grow up and I wouldn't trade it for anything. You may have heard of NH, the "Live Free or Die" state ? It's not anymore. I even had one town official at my old town hall tell me with a straight face that that old saying was outdated and needed to be changed. Anyway what happened, slowly, not overnight, was that people from MA, CT, NY, NJ, etc began moving to NH. To "get away" from the big city life and out into the country where the air was clean and your kids could be out after dark without fear. Buttt. they neglected to leave their attitudes behind. Their want for big government, huge police departments, multi million dollar schools, or as the old town clerk once said to me, street lights on the dirt roads"... Well not only did they make it suck to live there just as much as the place they came from, someone had to pay for all that as well. Higher taxes was the only answer of course. So finally 2 years ago I threw in the towel. Stick a fork in NH, it's DONE, change the name to Northern Massachusetts and last one out hit the lights.... I gave up and moved to rural East Tennessee. Never had the "flatlander" attitude that killed NH so I seem to fit right in down here. Don't want to change a damn thing about how they do stuff here. Property taxes went from $5000 a year in NH to $385 a year here and I have a nicer place. Unincorporated town with no police, no town government, no fat mayor to skim off the top, nada.. Go figure. And shooting ? Yeah people here have guns. I met one of my neighbors last year when I kept hearing a gun go off and then something bouncing off my metal roof. So I went out to see why... He was across the road in the field hunting doves and every now & then the wind would catch some birdshot & drop it on my roof. No harm done. We had a nice talk about the sport, shared a beer, and went on with our lives. He owns 200 acres of corn fields. I think we need to have a discussion about metal detecting in the Spring.
