the alcohol didn't effect his aim . he still hit the pole
ORWIGSBURG – A judge dismissed a driving under the influence charge Tuesday against an East Brunswick Township man.
Barton, 49, of Orwigsburg, no longer faces the DUI charge that state police at Schuylkill Haven had filed against him for an incident about 11 p.m. Feb. 24 on Reddale Road in West Brunswick Township.
After a 45-minute preliminary hearing, Magisterial District Judge James R. Ferrier ruled prosecutors had not offered evidence that Barton was incapable of safe driving due to the alcohol he had consumed when he crashed his sport-utility vehicle into a telephone pole.
