I am new to detecting so do not know a ton about the rights and wrongs.

Are churches public or private property, In other words do I need permission to metal detect on church property?

As for road sides I have 2 questions.

The first is about the space between the curb and the sidewalk in a neighborhood, Is this public or Private? And do I need permision to detect on them?

The second question is about the space between the road and the traintracks out in the boonies. There is a place I want to detect along a historical route that is about 300ft wide between the road and the traintracks. On the other side of the traintracks is a river in one spot and farm land in another spot (the river segments the farmland). Would this be public or private and do I need permision to detect here?

Anybody know please let me know.

Eric

Churches are usually considered private property and I'd suggest contacting the minister or priest. If one's not available offhand then generally one of the deacons might be able to help with the proper contact.

The curb to sidewalk has been brought up before. I believe the general consensus is that it's pulbic property although the property owner pays the taxes on it, even though it's generally considered a utility easement.

The area between the highway/roadway and a train track is considered private property and is owned by the railroad as an easement.

If you don't own the property it is private!!!! Always make a call, most people will say OK, but better to be safe. By doing this you help all of us!!!!!!!

I'm Going to go Against ALL Princopals of Right & Wrong, on the space between the road
and the train tracks out in the boonies.

(I live in the Boonies.}
And IF I wanted to do that space, I'd do it
Without Permission. Or ask a Road Crew or COP.

Because, UNLESS I'm Mistaken,
Even out in the boonies
the Rail Road is Going to say
Absolutely Not, It's Private Property. Their Reason
: LIABILITY

there are Many Areas Here in Central PA, Where
Roads Cross Tracks.
Some Dirt, Some Black Top. BUT everyone
has a NO TRESSPASSING
Sign , saying You Cannot Even Cross the Track.
Do they Arrest anyone ?
NO will The Cops arrest you IF they see you crossing ?
NO. the Signs are Simply to Protest The Railroad From Liability,
IF you are hit by a Train.

WARNING ! Don't wear Headphones Near Tracks !

I Am NO Lawyer.

I am NOT telling you To Listen to me.

if YOU DO IT & GET ARRESTED, I'm gonna say, "Ooops ! Sorry" :(
Because Your Boonies May Be Different then Mine.

All I am Saying is, I Don't think the Rail Road in All Good Concience Will say Sure Go Ahead.

I Do Not Do These Areas at all.

Nice point Jeff. This area is what I call a gray area. We all go there from time to time.
