A father was arrested for attempting to pick his kids up from school in a startling new example of how the state is increasingly treating children as its own property.



Making a stand against what he considered a dangerous and illegal new school policy that forces parents to wait in a line of cars outside until children are released at 2:35pm, Jim Howe tried to walk his kids out of South Cumberland Elementary but was arrested and now faces charges of disorderly conduct.

“You don’t need a reason as a parent to go get your children. They are our children,” Howe states in a video of the incident.

The officer who made the arrest, Sheriff Deputy and School Resource Officer Avery Aytes, responds to Howe’s attempt to pick up his own children by stating, “I’m going to call some help down here and we’re going to take you up to the jail right now. I’m not putting up with this today. You’re being childish and it’s uncalled for.”

The school secretary attempts to get Howe to fill in a form to authorize the children to leave the school on their own, which Howe refuses to sign because he is escorting the children out of the school, stating, “They’re walking with me when school is dismissed, per state law.”

Aytes refuses to allow Howe to pick up his kids and then states, “The County jail is where you’re going,” to which Howe responds, “That’s fine I’ve been there before, adding, “You just opened yourself up for a lawsuit.”

The officer then accuses Howe of intimidating him, to which Howe responds, “I’m not raising my voice, I’m not confrontational, I want my kids.”

When Howe begins to quote Tennessee state law, the officer tells Howe to put his hands behind his back and proceeds to handcuff him. After walking Howe outside, Aytes then threatens to arrest Howe’s fiance Amanda Long who is filming the incident.

Video footage of the outside of the school clearly illustrates Howe’s point. The school has enforced a ludicrous policy which forces children to walk out into moving traffic rather than have their parents safely escort them to the car.

Deputy Aytes refused to comment on the case, while Cumberland County Sheriff Butch Burgess, whom Howe attempted to call during the incident, told ABC 6 that he agrees with Howe on principle because the new policy is creating safety concerns. The school has also refused to comment on the incident or the new policy.

Critics of the encroaching nanny state will see this as yet another example of how the government treats children as its own property while parents’ rights are eviscerated.

This collectivist ideal was encapsulated earlier this year when college professor and MSNBC host Melissa Harris-Perry caused an outcry amongst conservatives by stating, “We have to break through our private idea that kids belong to their parents or kids belong to their families,” as part of a promotional video for an MSNBC campaign entitled ‘Lean Forward’.



Schools across America are also telling parents that they need to have a doctor’s note in order for their children to be allowed to bring packed lunches, while others are fining parents for not including certain items in packed lunches.

Meanwhile, in other major western countries, children are being assigned a “state minder” from birth under draconian new proposals that would enable the government to spy on families under the justification of preventing “child abuse”.
 

If I could ask? Which other major western countries are assigning children "state minders from birth"?

Why would it matter dave? Did they adopt our Bill of Rights and Constitution? If not , who cares what they do.. but it is too bad for them.
 

After 30 or so years in public education I think that these rules are a lot more about a school avoiding a lawsuit than it is about the kid's welfare or safety(just my opinion)

That is probably true.

The problem I see is that logic would dictate that it is safer for a child to leave in the company of a parent than to be out possibly having to move through traffic to get to their parents auto.

BTW, what ever happened to kids riding the cheese wagon? Seems that would do a lot to ease the traffic problem.

As for the dim bulb in the second video, I found it particularly interesting how she went on to say: "We haven't had a very collective notion of these are our children."

As a child, I remember when the entire neighborhood looked out for each child ... but they still had their parents to answer to if they misbehaved.

Then the libs came in and decided that the child belongs to the neighborhood ... close but no cigar. The child is not the property of the parent, however, they are the RESPONSIBILITY OF THE PARENT. That is where they get off track.

The restrict parents from carrying out their responsibility to guide the child to adulthood. In effect, they want the child to grow up mostly untended by the parents other than their providing food and shelter. They don't want parents to educate their children about life and terrible things like manners, responsibility or respect.

Basically, they want you to treat your kids like the pet rabbit in a cage. Check their water bottle, check their food dish, provide them with plenty of straw, and clean up their poop.

I think the school should be sued. I think the police department should be sued. I think the rent-a-cop loser should be fired after he gets punched in the mouth for running it. Welcome to the new Amerika.
 

clearly there is no limit on "stupidity"--the man was walking how without endangering himself can he "get in line" with a bunch of folks in cars? they should have just hand over the mans kids to him and let him be on his way --since his walking up approach (square peg) did not jive with their (round hole) drive up mode of dismissal -- basically he "screwed up" their system - and we all know t"he system" is correct and must be protected at all cost ..(so arrest the dad for not fitting in ) bunch anal retentive morons.

I could be wrong but I got the impression from reading this that apparently this father was known to the Sheriff Deputy prior to this. It sounded that way to me anyway. That begs the question, for what was this father known to the Deputy and why. Had this father come to this school in the past and done the same thing? Having to sign a form for removing your children/grandchildren from school is just real fine with me and I'm all in favor of it! It's a safety thing, both for the children and the school! Why wouldn't this father sign for his kids to take them out of school. Sounds like he's just a trouble maker, looking to cause a stir and he got exactly what he deserved! Now, before my fellow conservatives here jump all over me here, let me explain please.

Back in the day, and I do mean BACK in the day, there were no strict rules for adults taking kids out of school. I'm talking now back in the late 70's and early 80's, on up. Kids were being kidnapped by one parent or the other and too, by strangers and taken to places unknown. The schools were being caught up in law suit battles and the kids were, well some made it back and some didn't. I know this for a fact and before President Reagan gave the 10 million to start the Missing and Exploited Children's Center, my company and I were a major force in locating and recovering these children and bringing them home again to their parent or parents. We were probably THE major force at the time!

In the years since, the media, the legal system, the municipalities, the states, etc, have cuaght up somewhat in helping to prevent child kidnappings, but with that come some additional safety regulations. When I go to pick up my two minor grandaughters, at first until they knew me, I had to sign and show ID!! That was just real fine with me because it was for THEIR SAFETY!! It should have been good with this father too.

Waiting in line, in a car to pick your kids up too is a safety factor. Little kids have a habit of getting excited and running out to mommy or daddy and God Forbid that just onechild would run out in front of the car in front of mommy or daddy, when they got excited and get hit by that vehicle.

I personally think this father that got arrested is a complete ASS and did this just to stir things up! He belongs in jail just so he'd cool his jets! He'd be one of the first people to sue a school district for letting his children leave school in the unauthorized manner, should something go wrong with that unauthorized release too!! I'd bet money on that one and I'd win!

Look where I live. Most of the kids have multiple people that are parents, guardians or on the list of who can check the kid out of school. Then mom, dad step mom or somebody gets a restraing order, a court decision or something else removing someone from the approved list, doesn't notify the school, school lets the kid go with the wrong legal individual, cops get called and school district gets sued. Seen it happen...
 

Nobody has ever had to sign out there kids after they are already out of school. Doing it the way the school wants them to do it requires the kids to walk across traffic.Who cares if the cop knew the parent it has nothing to do with what is going on,,other than prove the cop knew they were his kids. To call a parent an ass for being a responsible parent is as stupid as it can be..It is apprent that you can not understand what you read,,And GOD please for the sake of the kids please do not allow this person to have kids or be in a position of power.
 

School's out. I'm here to pick up my child. I have to fill out a form? Go screw yourself a hole, you know who I am. That would have been my first words. As far as i'm concerned what the school did is nothing but totalitarianism. This is a prime example of the thoughtless, robotic sheep that exist in this fear mongering society that we live in today in this country. Humans are the same today as they were in the 1970's. The only thing that has changed is the information available at their fingertips. The vast majority of people don't know how to handle that information. That leads to the present state scared, non-thinking sheep willing to follow and do anything someone with the least bit of authority tells them to. Free thinking individuals are now considered dangerous (even terroristic) in this country. THE SHEEP RULE! Drink it up! The conditioning appears to be working.

There is a legal doctrine "in loco parentis."

In some states, the school is responsible for a child from the time that child leaves the school until she or he arrives home. The law, of course, changes from time to time.

We recently had a case in Oakland of a man who went to a school, asked to remove a child by name, and then hung around for a while on the campus before leaving.

Had the school simply turned the girl over to him plenty of people here - with good reason - would be howling.

To those who critisized my calling that parent an ASS, well it's obvious that none of you have ever dealt with brutalized, maimed, mentally abused and dead children who were removed illegally from playgrounds and YES, schools. Go on and run your mouths all you want. In actuality, you know absolutely NOTHING of what you speak except to appear to want to state some idiotic independence type BS line about being able to pick up your kids at school however you want to. REALLY!?? Well too, let me tell that one poster that for a fact, that yes, people have changed and many that have changed have not changed for the better. Again, I'm speaking from experience and not just like some, running my mouth with nothing to back it up.

As many of you will recall, who are old enough, back in the late 70's and early 80's the public was starting to wake up to a major problem in this country, the REAL problem of kidnapped children. There were two types of kidnapped children, stranger abduction and parental abduction. While the numbers thrown around were touted to be in the millions, in actuality there were about a million children a year taken and of that million kids, 70% were parental abductions. Parental abduction for those of you who like running at the mouth about what you don't appear to know anything about is when one parent or the other takes one or more of their own children, due to marital difficulties or a divorce in which they have already lost custody or figure they will lose custody in the near future, and that parent abducts the child/children to parts unknown and supposedly starts life over, never again allowing the other parent to see the abducted child/children.

Now, you might think like most people that, oh well the kids are with their parent, so what is the problem? Truth is that of the 1054 kids that my men and I located and/or brought home, close to 99% were physically abused badly! 100% were abused mentally!! A little girl with cigarette burns over most all of her body for not doing what she was told to do, as punishment. is a great example. You see, in order to stay under the radar with these children, the abducting PARENT would tell these kids one of three things to cover the absence of the other parent. Mommy or Daddy is dead. Mommy or Daddy will hurt you if they find you, or Mommy or Daddy will kill you if they find you. One of those three was told to the child in 100% of our cases.

In order to further conceal the child/children, the kids' names were changed, their hair was often died a different color, and the kids were denied ALL medical and dental care, for fear of exposing the parent and the children to the public and being found. In most cases the children were denied any school attendance too.

The abducting parent would often pair up with a boyfriend or girlfriend who would be abusive to both parent and the child/children in some rather gruesome ways too.

Oh and the non parentally abducted, just plain stranger kidnapped children, were bought, sold, and used sexually in some of the worst things you can imagine. Most were not recovered alive.

We never asked if a person who wanted to help was a Repub or a Democrat, we just took all the help we could get from anyone in the general public who would help us change state and national laws. We successfully were able, through speaking engagements to many various groups of people on both sides of the aisle, to get state laws changed and then through judges and DA's to get them to then uphold new laws to protect ALL children from state to state. The mai law that helped us with this was the UCCJA or the Uniform Child Custody Juristiction Act. That meant that custody papers from one state would be honored in all the other 49 states. Prior to that point, they were not. I very PROUDLY state to you that we also believe that we had a great deal to do with making it a felony level offense to abduct a child, as a legal parent, when you did not have legal custody in all states.

No, I don't believe like that pathetic MSNBC women does and I firmly believe that these are your children to take responsibility for and fully care for, however when those children are out of your sight and in school under the care custody and control of that school, that school or any other organization owes you and your children the assurance to keep your children as safe from ANY harm as possible. That includes MAKING SURE who takes your children from school and that that person has the authority to do so. If that means signing in or out, or showing ID to pick them up from school, so be it!! If you disagree with that, you are a damn fool and have no idea what is really going on in the world today! Stop critisizing the school for trying to keep your kids safe and back them up and cooperate as best you can. Hell, when you take your kids to Chuck E Cheese, they put a bracelet on them matching one on you and no one else can take them out of the store without that matching ID. Oh yeah, I also had great deal of imput on that particular one too!

I have seen the results from not taking these measures and they are not pretty. All things are not being done to take away our rights as parents and grandparents! Some are actually being done to help us keep our children safe from those who would harm them.




Because of what was done to improve and pass certain laws, your child or your grandchildren are now safer. Most people would say, "Oh that can never happen in my family because of my wife or husband, or son or daughter in law wouldn't do something like that"...UNTIL it happens.

Thank you Old Bookaroo. I was on a number of major TV talk shows about this problem back in the day and when asked then, or even now by someone, I say the same thing. It was some of the most frustrating work I have ever done but, by far, it was the most rewarding work I've ever done. Never could understand how someone could hurt a child and I guess I never will. Thanks again for those kind words!

I am not convinced the world has changed for the worse. Sadly, I think this sort of thing has been going on for a very long time.

The difference is awareness of the problems. I hope - obviously, in part, due to hard work by people like yourself - things are getting better.
