I think it may be a militia sword of the Civil War era or a little earlier. The fraternal swords usually have some identification of the order, initials, symbols or something. The militia swords are very similar but lack the fraternal order markings and are usually somewhat less ornate. Do a google image search on militia sword.
I found one very simular about shoulder high in a mesquite tree. Located a "square area" from aerial photographs on the Webb/Zapsta county line in Texas. It was on a bluff where a creek joined the Rio Grande A good hour walk from the highway. Also found the shoulder piece from Spanish armor. Still had the leather straps on it. A lot of stuff went missing before, during and after the divorce. Also a gold peso and a gold 20 peso.
