So I messed up today. I just moved to TX from Wisconsin and just found a great place to look for arrow heads. I went out yesterday and found three just sitting on top of the ground. Thought I would go back today and look for more. Found one right away lots of nice flint sighs of a camp and getting really excited when all of a sudden a game warden pulls up. I was right in an old Indian village. This is when it turned upside down. Ticket one I didn’t have an access card to be in that area since it was on military ground $125.00 I had a big piece of flint rock on me (and an arrow head that I dropped before he could see it) $125.00 the flint rock I had was an artifact another $200.00 and I had a fire arm in my bag not register to fort hood $75.00 plus go to jail witch he let slide. There was like 3 other things he could have written me up for that he let slide. Once I get an access card I can go hiking back there just cant pick anything up. What should I do I know right where the spear point is. The stuff is just sitting on top of the ground waiting to be picked up and I have the bug bad.

Double Check, but I have seen on the books in Texas that if its open land and you are not crossing any fences, there is no purple paint on posts, and no signs against trespassing posted then you are welcome to be on the land.
If it was owned by the US Government and there is no signs posted as a restricted area you can be on it. The only time you should need a permit is if its state or national park.

The game warden is a state official not a government offcial the most he could do is detain you and let the military decide whether or not to press charges on you for picking up said artifacts. Even on private land he cannot do that, only on state land does he have that authority.

The gun thing well I am surprised he didn't hang you on that alone. Do you have a conceal to carry license? If so I think that would be a questionable ticket as well.

If nothing else go in and pay your fines all in unrolled 50 cent pieces and make sure you tell them the GW name who ticketed you. They will have fun counting it and then have fun at the bank depositing it.

"unrolled pennies even better"...I can't remember the particulars of the case, but someone tried that with an electric company a few years back and they took the person to court...the court ruled in favor of the electric company...the pennies were not considered payment...another piece of worthless trivia stuck in my mind...
 

Seems to be some differing opinions on the legality of artifact collecting in Texas and I would like to firm that up before I visit next fall. Does anyone know for sure what the law says?

Just a side note Tx.... There are Federal Game Wardens.... If you hunt migratory birds... such as doves, then you might just see them pop up on your land.
 

if it made by the us govt as money * it is valid for payment of debt , otherwize the electric company is saying the us govt's money is no good. -- they do not have the right to do that nor does a judge.--- federal law is over state law thats the facts.
 

This post has drifted off of the subject of Artifacts. I think the poster has gotten plenty of advise on this issue, and I don't want it to turn into a witch hunt. We seem to have a good peaceful forum here. Enough said on this topic, and like I said we are drifting away anyway. This Topic is locked. John
