Is it true that you can get arrested and fined for Metal Detecting in Ireland?

I posted a link to the regulations in another thread, you need a license and special permission from a government minister to 'search for archaeological objects' and if caught with a MD and actively digging etc you can get a fine of up to 63,000e ( 83,000usd). That being said, a fair few people, including myself, have licenses.
