Some miners who have participated in the mining law forum just posted this:

From a Idaho miner: Posting this on : americanmininglawforum.myfastforum.org :: Index
================================================== ============

Interesting: Just got word of this. Hope anyone can make it from anywhere.

I just got off the phone with Mr. Chmelik and he wants this done soon. He said, "I am bringing my Sheriff with me and if they want to harass or arrest anyone, then they will have to arrest us all!" Mr. Chmelik wants a goal of 5000 + miners to make the "Occupy Our Rivers Movement." Our two senators have jumped on board to help Mr. Chmelik. So keep an eye out for news on this to come. In the meantime, read what Mr. Chmelik wrote in the Idaho County newsletter:

OCCUPY OUR RIVERS

CALL TO ACTION

Recent Events in Idaho have prompted several citizens to take actions and demand accountability from their government and I am extremely proud of their actions in their quest for justice.

Two weeks before the Riggins Rodeo the BLM attempted to close Shorts Bar and Island bar. These two beaches are central to accommodating spectators who travel from out the region to enjoy the rodeo and the beauty of the Salmon River. Two weeks before the jet boat races the Coast Guard attempted to shut the race down by not sanctioning the race. In both of these cases citizens stood up and said no and that we the people have had enough.

Now the EPA under the threat of a lawsuit from the Idaho Conservation League is saying no to recreational dredge miners on the premise they are introducing a pollutant discharge into the river when nothing could be further from the truth and U.S. Supreme Court precedent reinforces the dredge miners position. If they can do this to the dredge miners, the jet boaters will be next.

If we do not take action and unite, then we get the government we tolerate.

It is the view of this elected official that we come together and peacefully assemble to petition our government for a redress of grievances, and formally protest the out of control tyrannical government imposing their ideas of how we should live in the west.

If the socialists can come together and occupy Wall Street, surely we can Occupy the River for a day. I would personally support all dredge miners and all other interested parties to come together and have a day of protest. It is our right and I believe our duty to stand united. As a sitting county commissioner I will personally assist the dredgers and dare the EPA to arrest me while exercising our First Amendment Rights. Can I count on you?

One person cannot do everything, however, together we can all do something. We need people to help us organize this event, set a date and get the word out. I will leave you with this thought, In 1857 in his personal conviction in battling for freedom and the equal rights of all as provided for under our Constitution, Frederick Douglas stated, "Power concedes nothing without a demand. It never did, and it never will. Find out just what people will submit to, and you have found out the exact amount of injustice and wrong which will be imposed upon them; and these will continue until they are resisted with either words or blows, or with both. The limits of tyrants are prescribed by the endurance of those whom they oppress."

Sincerely,

Jim Chmelik

Just a dumb question, we are fighting the EPA but not Idaho. Shouldn't people at least have a IDWP to show solidarity with Idaho?

I have an idwp for the salmon, the whole open stretch. I'll be there with BLACK BETTY.

I've always wanted to dredge but haven't gotten into it yet. As far as I'm concerned I want it open so I can in the future. I want the EPA out of Idaho. Period. They are messing with something that works and we all know that saying....

From a miner/organizer:
THANK YOU. WE ALREADY HAVE ABOUT 100 CONFIRMED THEY ARE COMING. BUT I DON'T GET TO HAVE CONTACT WITH EVERYONE UNFORTUNATELY! I.E. 2 FROM INDIANA 2 FROM NORTH DAKOTA 8 FROM AZ 2 FROM TX 20 FROM WA & 8 FROM OR... AND THE REST JUST FROM AROUND BOISE.
AND WE DO HAVE A DONATION PAGE SET UP FOR BATHROOM COSTS AND TRASH SERVICES: PLEASE LET EVERYONE KNOW THAT ANYTHING HELPS AND IF THEY DONATE OVER $25, WE WILL SEND THEM An event T-SHIRT. HERE IS THE PAGE: https://www.facebook.com/pages/Oc...e-in-Event/648178355254220?ref=hl

Most of us who were on the SF Payette and BOISE river last year are actually going back there after this event is over. And we aren't getting the EPA permit either. That is the purpose of the protest. It isn't just for the week, it is for the season. The week is just to be able to gather bodies to show the governor, the legislation, and all the nay sayers that this can and will happen on opening day (6/30); while being a success.

EPA CAN'T ENFORCE A FEDERAL RULE, especially if they don't have the staff to do it. Last year they said they don't have the staff to corner everyone and if no one gets an EPA permit, then they don't know where to go looking for people.

See in my opinion, I believe that those stupid papers are death traps. They ask you where, when, why and how... Why?? Just so it is easier on them to find you and harass you?? I don't buy their permit and I've been through the courts before, and I'll do it again! I AM FIGHTING MAD! AND I REFUSE TO BE A SHEEP! LET THEM COME FIND ME ON THEIR OWN, AND THEN WE WILL SEE WHAT HAPPENS.

My point is come and bring your friends and enjoy a PEACEFUL, CIVIL, FUN AND FAMILY oriented demonstration and prove that Americans are still willing to stand up for our rights. We have to in order to leave a future for our children.

JUST THOUGHT I WOULD PUT THIS OUT THERE:

After a meeting today with Congressman Raul Labrador's aid, it is apparent that they believe two things and only two things. 1. The constitution is dead; yes, i wrote dead. And 2. That a sheriff does NOT have any constitutional authority whatsoever!

NOW REMEMBER THIS WAS IN A CONVERSATION JUST TODAY 5/5/14 REGARDING THE Occupy Idaho Waters: Anti-Epa Dredge in Event.

NOW GO VOTE THIS COMING MAY AND GET THIS GUY AND HIS STAFF OUT OF OFFICE!

Do you have a Business? Do you have friends that have small or large businesses? Would you or your friends be interested in DONATING ANYTHING FROM SERVICES TO CASH for our event? If so, contact us today, we can get your name or business name on the sponsor list But we need to get you to donate before MAY 15TH. So everyone call around or check around and see who you know that would be interested in free advertising, with little donation! If they donate $50 or more we will make their names a little bigger on the shirt. Simple, right? Lets get to networking; afterall that's what FACEBOOK is for, right? Thanks again for all of your support!

Re: OCCUPY IDAHO WATERS
Postby rockchuckar » Tue Jun 03, 2014 9:53 am

I have been ask to ask as many boaters as possible to try and attend this. I have heard thru the grape vine that if the group that is pushing this gets their way and gets dredging stopped on the Salmon river that their next target will be us jet boaters. Here we go again !!

To: Jim Chmelik

Hi Jim,

If you have any more questions, let me know and I will get back to you ASAP. Thanks!

Here is the things we have going on:

During this event (Monday, June 30th through Sunday, July 6th, 2014) We Will:

1. Be doing a NF Road #1617 clean up. Essentially, volunteers will be picking up trash along the Forest road. The bags were donated by Home Depot and Lowe's for the event.

2. Be having an educational booth, that will be explaining the affects of this EPA permit for ALL outdoor activities, whether it be Jet boating, mining, rafting, logging, hunting, fishing and so on.

3. Be shopping in Riggins for fuel and food and bringing a lot of money to your community. We feel local communities and miners can work well together to help everyone out!

4. Have a rally in the park on July 4th with speakers. We have already reserved the Park.

5. Be encouraging all occupants to go into town and check it out and most importantly shop there, eat there, and tour the little town.

6., 7., & 8. Want everyone to be involved so we can really work together and help each other out! We don't want to fight with or upset anyone and We only believe good will come out of this event for all!

9. Have medical personnel on board that will be on site all week and who have also contacted the Riggins Paramedics to let them know he is involved as well.

10. Have asked the the Jet Boaters association to get involved. It is up to them if they decide they will or not. We have also reached out to private jet boat dealers and have asked them to come and participate and seemed to have got a great response from them as well.

11. For safety purposes, be keeping an eye out and have many volunteers who said they will also help with security. By this, I mean we are asking people to keep an eye out for malicious behavior and to help reel it in or resolve it as soon as possible to ensure a fun, safe and secure environment!

12. Everyone wants to know about guns! We can't control them, BUT!!! We are asking for them to be left in their vehicles where they can be locked and kept away from children.

•A. If someone proceeds to open or conceal carry, we are asking that they keep it holstered at all times!
•SHOULD A SITUATION ARISE (IN ANY CAPACITY and for any reason) We are simply asking that people record any and all interaction with federal authority, via camera, cell phone and so on.
•THE SHERIFF HAS A JOB TO DO SO WE CHOOSE TO LEAVE THAT UP TO SHERIFF GIDDINGS AND HIS DEPUTIES!
•Please know, Idaho is an open carry state and most people are familiar with that. If they choose to carry and are NOT posing any threat, we will not address the issue!

13. Most importantly, we are going to follow all the state regulations that has to do with mining. We simply are good people, doing a good event for a great cause! Don't let the words "Occupy," "dredge," and "mining" scare you off, come learn and educate others that we all can get along and that we all can achieve a goal of getting our rights as American's back one step at a time... Thanks for your support.

Thanks,

IMPORTANT INFO FOR ALL PARTICIPANTS:
Another couple of things:

First of all, Riggins is one way in and one way out! You can't miss it. When the event gets closer, I will post a google search on here to give directions. But for now, if you want to check it out on Google earth, type in Shorts Bar Campground, Riggins, Idaho and you will see that the town sits directly across from the forest road and its campgrounds. Easy to find...

This event will hopefully bring media. We do know that 2-3 media writers will be there. If that is the case, we are asking all Occupy participants to PLEASE! refer all media questions to us the coordinators. If you want to be interviewed by them, that is great. But please, do NOT lose your cool. I am sure the press will be looking for any kind of "drama" they can find to fabricate in their stories. Let's not give that to them!

KIDS: There will be a lot of people at this event, if a child goes missing, please find coordinators immediately. We then will part to look for missing child. Also, the Salmon River is NOT a forgiving river, so please, we are asking that All children/kids under the age of 16 need to be wearing life jackets when near any bank of water or edge of water. The Salmon is an extremely large, fast current, deep, and cold river. We do not want to lose anyone especially a child to it! Just be aware of your surroundings.

Also, IDAHO is an OPEN CARRY state. Because this is the 4th of July (Freedom Weekend) and a civil protest, we do NOT believe that restricting the 2A would be wise for this event. BUT, WE ARE ASKING THAT ALL FIREARMS ARE TO BE HOLSTERED. OTHERWISE, PLEASE LOCK THEM UP WHERE KIDS CAN'T GET TO THEM ACCIDENTALLY!

WE'VE been hearing that a lot of claim owners are getting harassed by the BLM/USFS on their claims about camping. Well in their own Regulations book it states this:

§3715.2 What activities do I have to be engaged in to allow me to occupy the public lands?
In order to occupy the public lands under the mining laws for more than 14 calendar days in any 90-day period within a 25-mile radius of the initially occupied site, you must be engaged in certain activities. Those activities that are the reason for your occupancy must:

(a) Be reasonably incident;

(b) Constitute substantially regular work;

(c) Be reasonably calculated to lead to the extraction and beneficiation of minerals;

(d) Involve observable on-the-ground activity that BLM may verify under §3715.7; and

(e) Use appropriate equipment that is presently operable, subject to the need for reasonable assembly, maintenance, repair or fabrication of replacement parts.

So go tell them to reread their training manuals...

FOR THE RECORD:

The NEGATIVE rumors about the Occupy event ARE SIMPLY NOT TRUE!!!

So the event IS STILL TAKING PLACE & nothing has changed!
So the event IS STILL TAKING PLACE & won't be interrupted by gun slinging baboons !
So the event is STILL TAKING PLACE & no!, there won't just be a "FEW" people at this event... There is going to be a LOT of people at this event!!!

So for the record, always send any questions or concerns to us! And we will let you know what's the truth and what isn't! Thank you!!!!
