Tuesday at about 10 am, my wife and I were rear ended, and my car was totalled. Everyone is pretty much ok. My wife has a bit of whip lash, and my young brother in law got a staple in the scalp. I was hit by a company truck of a local business (town with population of under 2000). I am pretty sure his insurance is going to do right by us. This is going to put a damper on my detecting activities for a while, along with my ever worsening herniated disc. I have switched to CRHing for the time being, until I can get out and swing a coil again.

One thing is troubling me though: Just about everyone I know has immediately suggested that I sue. I do not think that is the right course. The man that hit us was so upset, and so genuinely concerned about the well being of my family, I do not feel that I need to go after him legally yet, nor will I have to. I guess people my age (31) tend to be either too cynical or too greedy for their own good.

I was rear ended twice in six months years ago and I can tell you that the insurance company is going to try and settle fast and cheap. Don't sign anything and do not make a statement to them over the phone or in writing. Don't expect them to compensate you for any of your back issues because of your well documented problems. They will try and get you to release all medical records to the begging of time time to include any mental health, military records, hospitalizations, and anything else they can think of. You will have to release this information but DO NOT SIGN THE ONES THEY SEND.

Retain a personal injury attorney so you don't get screwed on anything. They are to protect you so that you get what is rightfully yours (medical bills covered and car replacement and pain in suffering). Have ALL PAPERWORK go through them. I had an insurance company try and send me a release for liability that was hidden in the wording of a medical release so they did not have to pay for a thing and the lawyer found that. I missed it at first...

Bottom line... They will screw you if they can. So protect yourself and retain a lawyer.

Oh, I have been through that before as well...but since the insurance company that insures his business is the one that has been in this small town for nearly a hundred years, and he is essentially a neighbor....

If I have to go back to the doctor, the beauty is that I can get another MRI done and show pre and post accident damage pretty close. Since we are still fully covered by TriCare, the medical is not an issue. All I really want is at least what I paid for the car, or as close as I can get since I paid for that car completely, since it was my first car I ever bought all by myself and fully paid up.

As I said, I will get an attorney as soon as I hear a low ball or insulting offer. But I am also going to reserve judgement until I get any offer at all.
 

Yeah, go ahead and sue dude. It's the American way, right?
 

2 & 1/2 years ago I woke up to a beautiful sunny day , jumped on my Harley an headed off to work , stopped at the gas station turned the bike off an threw the kick stand down , just as I was taking off my helmet a cargo van with a roof mounted rack full of construction equipment went to pass me as it did it snagged the roof rack an dumped about 1,400lbs of construction equipment on me an aluminum ladders , Doctors took me off work due to my injuries an 4 days later lost my job , I still have not been released to go back to work .

the guy who did this to me was very sorry an felt bad to ,do yourself a huge favor an get an attorney NOW do not wait ,Mine was with a local company vehicle also ,GET A ATTORNY , you have to cover your own butt , let the attorney handle everything an deal with all the hassles .

I cant stress this enough after goingthrew all this , hope everything works out good for you an everyone heals fast .
 

I forgot two other important details....the guy driving was the father of the owner of the company.

Also, I already have on retainer one of the best lawyers around. I just do not want to go that route until I have to. Medically (ok, I was already broke) everyone is ok, and all he would have to pay for is three ambulance rides, and a few incidentals.
 

I want to tell you about my daughter. She was in a car with a Friend and a tow truck ran a stop sign and hit them. She broke her hand and hurt her leg fro the impact. She had her degree in hair cutting and worked for a hair stylish in town. She was out of work for 8 weeks and have never been able t cut hair again because her hand will hurt as of today if she is using it for a hour or so. The insurance company try to offer her $5000 to settle. I told them we would not settle for less the $50000 they argue with me and I told them that I would get me a lawyer and they could work it out then. When they hear that I was going to see a lawyer they settle. I think we settle for to little as she has never been able to use her hand for long period of a time and her leg still hurts her. So get a lawyer and have them hassle it out. As you don't know what kind of problems you will have down the road......Matt
 

You should consider what the impact of you injuries will have on you later on in life. Just because you do not have any visible problems now, does not mean that problems will not show up later on.

Just something to think about. You should be compensated for your property damage, lost wages and any medical costs associated with injuries sustained.
