Are recreational mining claims valid.

Good question that I'm sure many may have wondered. In order to have a valid claim first the "State" requirements / criteria's need to be meet and of course the federal also needs to be meet both within time limits. How one works the claim is mostly up to the individual after the "State" and "BLM" requirements are meet with working, recording, amending, and perfecting the "Claim". There cannot be more than a two-year gap or failure to work the "Claim" also referred to as abandonment. Others will also include more here however this is just an overview.

I’m assuming “recreational” and casual use” are specific to mining or respecting on land that is not held under a valid mining claim.

That is what was being pointed out specifically in posts as well as a number of questions to help one sort out one vs. the other.
One should not assume that there is a valid mining "Claim" without both the "State" and "BLM" requirements / criteria taking place in a timely manner.

However, it’s also legal to pan on unclaimed BLM as long as it is casual or recreational as far as I know.

BLM points out that “recreational and casual use” of public lands is separate from a mining "Claim" with a valid "Discovery" being made.

“Recreational” and "casual use” can cover similar activities on the land that most people know about.

For example, “Recreational and casual use” is not "Recorded" and carried out in a timely manner within the County records like a mining "Claim" with a valid "Discovery" will be.
BLM may not update without checking on this to start with however will still except a transaction / fee acceptance as required.
Each "State" will have requirements spelled out in writing and will be different from "State" to "State".

iv got lots of claims that iv been going to for a long time,mostly using a 12 volt drywasher.but ive been thinking about using my gas powered vacuum to clean out some bedrock.iv heard its ok if under something like 5hp.but can find it in writing anywhere.i just dont want to get a ticket,what do you guys know about this.so this is in calif on a claim on blm land, thanks brad

Can a gas engine be used on the surface outside of the fire season could be the question you are asking?
Dry land / rain fall conditions will dictate the fire season requirements.

This is likely off of the topic thread question started by 1637.
With that being said thanks for pointing out that a hair style would be so famous.

Since 1637 has claims recognized by the "BLM" pointing out a number of CFR's by a member may not have any Bering on the question asked.............just saying.
Some would say there is no nexus connection due to this fact.
