I got this e-mail from a land owner the other day.

"Turns out, insurance guy may have an issue with unrestricted relic hunting on the property. Make it a single trip if you have yet to go. If you have already been out there, please consider that the 'one trip,' and I hope you made some interesting finds (or, at least, had a pleasant day!)."

So how do I respond. This place has been good to me(or at least my friends) good coins, a US belt plate and I know theres more.

Any ideas would be great. BTW the place will be for sale soon

not what you want to hear, but---
just say "thank you", and hope it sells soon to a more cooperative owner
 

People love to make up stories and if he really did contact an insurance agent, ALL insurance agents will ALWAYS say it's a risk and not to do it, allowing anyone on your property for any reason is a risk.
 

relic-hunter's answer is spot on. If you ask an insurance agent anything, naturally they're going to tell you "no", or "I wouldn't risk it", etc.... For example: I own a small business. As such, I have a commercial property. Over the course of time, I may have non-employees in the building (metal detecting friends stopping by to say "hi", or the homeless man we let come collect our aluminum cans, etc...). Now I bet if I were to ask our property insurance person "Is it ok to have my buddy [a non-employee] stop by?" or some such silly question like that, what do you think their response would be? ::)

So it sounds like whomever that land-owner is that you're dealing with, is the one who doesn't want people there. Because just as in the example of my property above, I can have whomever I want there.
 

Here is a form I use when asking for permission. It pretty well covers the concern in this thread. I make sure that both the property owner and myself sign it and each has their own copy.

I, *********, in return for permission allowing me to metal detect on property owned by

______________________, do hereby waive any responsibility or liability on his or her part for my safety or well being. This document being proof that I recognize that I am responsible for any risk or damage to myself and that said landowner is to be held blameless in the case of accident or injury.

In addition, I promise to fill any and all holes I should happen to dig and to do my best to leave the property in as good a condition as when I entered.

OK I'll Tell you what I'd do.

IF the Landowner Isn't there to see me,

If he Dosn't Know I Made the "One Trip" Yet,
I'd go hunt it whenever I want.

If approached by the land owner,
"Yep I Finally got here"

If he is on the Property or sees Me,
I'd make sure I Had as Much of the Day as I can Tolerate
Before Leaving.

I think it translates very politely.

Hi, I'm being a nice guy & letting you search once. The insurance story hopefully works so you don't get too mad at me, but I've since bought a detector, and....................
 

Well, I thought all the same ideas as above believe me. I'm gonna try the nice guy approach this time with a call this morning and try the permission/ waiver form. I hope that will work. (Thanks luvsdux) I will let you know how it turns out.

Well i don't think that those waiver forms that is printed out by you................ Will not mean any thing to the insurance Co's or a Attorney............ They are just about or they are worthless.......... Just drop it .... Be real..........Just look at it as a thing in your past now..................And move on................
 

yep he think he is being nice he want you to hit the road he hunting now are someone he told. just like deer hunt you can tell what you see but not where . hh

First I would like to thank everyone who responed with postive or negative. Unlike the people who said give up, I dont have a endless list of productive places to dig(my only response to those commets). So I called the land owner this evening.To start he was super nice. He is a buy and resale kind of guy and this is the reason he purchased this place to begin with. I spoke to him about his consern about me being there with no one there. He stated his insurance reasons came about from another place he owns with deer hunters(seems like they are not going to be able to hunt this year either). I also talked to him about the possibilty of helping him do some work like bush hogging the fields to continue to hunt. In response he said he would call me when ever he went to the house, would think about the rest and give me a call.
So its not the most ideal considering what I had before but it still is a chance and maybe a small one to hunt. Most important I guess its the most honest. Im not comfortable hunting when it might be "questionable" as to lines or boundries. I guess thats my experience up to tonight. Thank you all for your responses again. T-net is and I hope will always be a good place for ideas and advice.

In Britain most detectorists have liability insurance to allay any worries a farmer or landowner has. Its possible you could be blamed for leaving a gate open leading to a herd of prize cattle getting on a busy road and a mass pile up happening.

My insurance through the F.I.D. (Federation of Independant Detectorists) costs £4, around $6 per YEAR. This covers me for £5 million, $7.5 million dollars.

I can understand where the insurance companies are coming from on this because if you fall down a disused well or a mineshaft and break your back you would take the landowner and his insurers to court.

Well the Thing with all our responses,
You Know the Man better Then any of us do,
& the situation. Including your Concience.

Of course I understand your Hesitations,
& have them Myself Sometimes.

I Just find it very hard to Believe he Talked to his Insurance
about it, unless he sits down at his Table for Dinner
regularly With his Insurance agent :tongue3:

I Would Never ask My Insurance their Opinion, or
Permission For anything.
Once they give it, Going over their head can be
a Problem.
(Sort of Like asking your agent if it's alright
to Burn a Candle in a Barn. If you do it after he says NO
& Your barn Burns down, Can it still Be considered
a Covered Accident ? or is it then Arson ? )

I heard this quoted to me. (don't know who wrote it)


"It's much easier to ask foregiveness than it is to ask permission."

In reality, a waiver like that means just about nothing in some states. Some states will want it notarized. But, I know that even a waiver in some states, like Pennsylvania, won't cya. (or the landowners). In Pa., you can get sued (and you will lose) if some arsehole person walks up to your tied guard dog, on your property that is post, and gets bitten.

Been there, done that. We are now in a world where we all have to be responsible for a dumb person's act.

Of course, it could also, like was said - just an excuse, and the landowner is trying to make it non-confrontational.

You could, bring an extra detector and ask him if he'd like to spend the day with you.

Sounds to me like you have been hunting the land of a really good guy who hates to be a bad guy so he is shifting the blame so as not to offend. But you have to rememberthat the property owner has the absolute right to control who enters his property. Say thank you and move on. Monty
 

That's a bum deal. Such a great place to with lots of stuff left in the ground. :'(
I got some good sites I'm trying to get permission for. We'll get you another spot in no time. :icon_sunny:
