Once again Brandons' lawyer has done a fantastic job! While I do not have a degree in law, his brief makes it clear that the refusal to issue permits for suction dredging is a thinly disguised ban on this mining method. That he points out the blocking permits for gold dredging while still allowing dredging for other reasons like waterway maintenance etc was a masterful stroke! It clearly shows that the state is attempting to ban the most economical method of mining an underwater placer deposit.
Let's all keep our fingers crossed that Brandons' case is over soon and with the results that we KNOW should be the proper outcome. The state has been grasping at straws and delaying for far to long here. I feel that they're resorting to the delaying tactics in hope that Brandon will run out of funds to keep the case going, which will allow the state to win by forfeiture. In my opinion, that is the ONLY way they can win.
