My interpretation" it means Digging up the streets and maybe Sidewalks
for Maintenance Purposes. Water Lines Etc.
in order to Get their share of the Costs. :dontknow:
Even New Sidewalks should be Exempt

Looks like screwdriver /probe type recoveries only around there!
Yikes!

County is in charge of a driveway culvert permit here.
looks like the borough would be collecting it's own fees there.
Right of way is 30 feet off centerline here as well , making putting in a driveway costlier by the Girardville article.
Maybe they have had too many problems with unauthorized digging or work?

I still Don't think Detecting applies , but an overzealous Official
or Crybaby could cause issues.

Probably Don't ask/Don't Tell may be in order though,
and move on first sign of a Crybaby or ground Nazi :coffee2:

It looks like the ordinance is about "cuttings, openings and excavations". I don't see anything in there about tearing up sidewalks, streets, metal detecting, what tools are used or exceptions based on the size of the hole.

Usually these "ordinances" are very poorly worded and have to be modified over time. If this area is important to detectorists I think they should be the one's to lead the charge on changes to this law.

For example this ordinance with it's requirement to get a permit seems to only apply to "residents". Not a resident? No permit required. Very poorly written and probably unenforceable as written. This is the cue for locals to get some reasonable changes passed at the next Borough meeting.

I wouldn't suggest Detectorists even Question it till a need arises through official threats leveled .

One thing I Disagreed with when the FMDAC was first created.
they started suggesting permits, & Public Hearings.

the phrase "Leave sleeping dogs Lie" Comes to Mind :coffee2:
proverb that dates back to the 13th century. The phrase is a request for a matter or incident to remain undiscussed or avoided, where addressing it might cause trouble.
