GRUBSTAKE - Hows that work, is it possible these days !

If you can find someone to grubstake you go for it. It's just a private contract between two parties. Some states do have laws regarding grubstaking so you might want to study those before you get too involved.

Here's a taste of what you will find for Nevada:
All grubstake contracts and prospecting agreements hereafter entered into, and which may in any way affect the title of mining locations, or other locations under the mining laws of this state, shall be void and of no effect, except between the parties to said contract or agreement, unless the instrument shall first have been recorded in the office of the county recorder of the county in which the property affected is located. The instrument shall be duly acknowledged before a notary public or other person competent to take acknowledgments. Grubstake contracts and prospecting agreements, duly acknowledged and recorded as provided for in this act, shall be prima-facie evidence in all courts of justice in this state in all cases wherein the title to mining locations and other locations under the mining laws of this state are in dispute.

It's a little different in California:
All grubstake contracts and prospecting agreements entered into after September 19, 1939, and which may in any way affect the title of mining locations, or other locations under the mining laws of this state, shall be void and of no effect unless the instrument has first been recorded in the office of the county recorder of the county in which the instrument is made. The instrument shall be duly acknowledged before a notary public or other person competent to take acknowledgments. Grubstake contracts and prospecting agreements, duly acknowledged and recorded as provided for in this section, shall be prima facie evidence in all courts in this state in all cases where the title to mining locations and other locations under the mining laws of this state are in dispute.

There are similar laws in most states. Just do a search of your state laws for "grubstake" and the answer will pop up.

Well, I'm not sure if this would qualify as grubstaking but a friend of mine drove thirty miles to the claim here the other afternoon just to ask if he could borrow five gallons of gas to get back...I pointed out the freshwater pump had a blaster nozzle on it /the gravel bench, the four inch still in the water and said go for it and keep what you find. He declined...I declined to let him borrow five gallons of gas. Now does that constitute grugstaking gone wrong????

Sounds like he turned it down so, its not for him.

Most grubstaking I've read of was a person own claims and the gear. Made an arrangement with someone to do the digging for a percentage take after repayment of cost of gear. With variations.

For both parties to come out ahead the ground would have to be good First. And the prospector would actually have to be willing to work. As the prospector will owe if he isn't successful. The claim owner stands to lose.

Did it once a while back more for "kicks" than anything else. A co-worker of mine (at my real job) and I made a deal; my truck, my gear, my diggs and my sweat ...."SOLO". He paid for the gas, food, drinking water, a case of Coors and bottle of Makers. This was my rations for 5 days of mining in the desert. The deal was he got 30% of the riffle tray, averaged 4-6 grams per day (plus some pickers) and this was back when gold was around $50/gram. Good spots are hard to find so I prefer not take any chances, most just can't keep it quiet.........we both made money.
