So I picked up a bunch of pool filters in a deal, all brand new in the boxes. I sold several and got great feedback. One person bought one and then sent a request to return it after they got it. They stated that the item was not as described and in their complaint, they said it is not a filter, it just looks like a filter and that it wouldn't get the green out of their pool. I sent them a message telling them that is most certainly was a filter and pool filters do not remove algae from a pool, algae needs to be treated, killed, and bound with a clumping agent before it can be filtered. They sent it back anyway, in a soaking wet box that got my mail wet when the P.O. delivered it and had a tag on it from the post office that it was received wet and is likely damaged. It was also broken and dirty, possibly the old filter. We called Ebay and they said that there is nothing they can do, they took our money and refunded the purchaser their purchase price and shipping. We told them it is a filter, it was brand new and now it's ruined, or possibly their old filter and they said it doesn't matter, if they claim it is not as described, they get a refund even if they don't return the item. Huh? So now you can sell something and someone can buy it and claim it's not as described, keep it, and you are then out your money, shipping, AND product. The ebay representative said they can send me their old pool filter and it doesn't matter, they will take my money and there is nothing I or they can do about it. Basically admitting to aiding and abetting fraud.

It only takes a few to ruin it for everyone. I only pray that karma takes care of those that lie and cheat...
 

I'm waiting to see what happens with an INAD case of mine some jerk off just filed. Meanwhile if he would have read the entire description and looked at all the photos, he would have seen that it is clearly mentioned and photographed in my original listing. I don't guess it's an actual case yet as it doesn't appear in the resolution center or my messages, only way I noticed it was when I looking at my sold items and saw a small notation at the bottom of that item. Looks like this-

I sold some electronics once only to have the buyer claim it didn't work when it arrived. I had them send it back for a full refund only to get an empty box filled with packing peanuts delivered to my door. Since the packing slip/tracking was pulled through the site, it triggered the refund as the package was 'delivered'. Luckily, after numerous phone calls and a police report, eBay reversed their decision and I got my money back.

I probably wouldn't quit eBay either. But stand your ground on this and be noisy as can be. eBay needs more of us sellers to start pushing back. Otherwise nothing will improve. If it was me I'd look and see if they have any items for sale and I would buy one. After it was delivered I'd destroy it and send it back to them for a refund!

Sellers need to start making some noise. The user agreement contains an arbitration clause, but doesn't exempt small claims cases. Also, I think if Ebay is abetting these buyers, they should be held accountable. If something like this happens to you, file a complaint with your state's AG. If enough complaints get filed, some ambitious AG is going to go after them for unfair deceptive trade practices.
 

I left Ebay years ago. I was screwed on 3 winning bids totalling over $200.00 and never received anything from the sellers. According to Ebay they were minors who posted items. I also bought something for $6.00 and the seller changed the check into a $60 check. My bank made this right and refunded the $54 to my account. I do not know if they ever prosecuted though.

After ebay got hacked a few years ago I tried to call and reset my password since I no longer had access to the email that my account was registered with. It was my old military email address. I called to do it over the phone. I got a message that they'd call back when I was next in line. 2 weeks later I saw a missed call on my cell phone from ebay on a Saturday. Needless to say I just said F_ _ _- IT and never attempted to reopen my account. I was expecting a call during normal business hours on a weekday, not on a Saturday while I was out detecting.

Thanks for letting me vent. Life is good, what goes around comes around.

Cheese, was the transaction done through Paypal? I believe Ebay and Paypal have now separated so that maybe Paypal may be another avenue you can pursue to get restitution for this incident.

I also don't like the fact that it seems I have no recourse because as a policy I accept returns. I do have a problem with paying the return shipping on something that was as described with photos and a description to prove it in my listing. Not to mention, if money is removed from my account before I receive my item back, i will be highly po'd and will be burning up the phones from here to Bangladesh and back to Ca.


And what happened to you cheese is just plain wrong. I would file an appeal if I were you.

Unfortunately it is the price of doing business. I just had a return that wasn't even the same product sent to them. These hood rats went out bought something else and sent it back to me. Different UPC and expiration date. Best you can do is block them and let others sellers know what trash they are. eBay doesn't care and will take the money out your PayPal account if you don't do the refund.
 

I think you should post the names of these buyers that have done this so everyone can be on the lookout for them. Not all buyers do this, I have bought plenty off of ebay and try to resolve any issues fairly.

I returned some hydraulic cylinders that were threaded wrong and when they arrived back at the place where I ordered them they said the 18 pound box was empty. I filed claims with the post office and everything and wound up losing over $300 because I didn't pay extra for insurance.
 

A guy I know told me he sold a pair of expensive boots...
They said item not as described and Ebay refunded...
When he got the boots back...
It was the guys old pair... trashed and stunk.

FYI ... if you pull the money out of your PP account, then PP can NOT take the money out of your banking account. (Yeah, I asked.) They are not allowed to take money out unauthorized. I pull all my money out every two weeks. I had a lady buy a $350 bracelet, and then claim credit card fraud. Duh. The bracelet shipped to the users registered address. 5 mins later, PP took the hold off the money (which wasn't there anyway).

I would call ebay again. And again. And again. They keep detailed records. You have pictures and your description, right? I'm sorry this happened to you. Just really stinks.
 

Since the buyer used USPS to return the item, you may be able to file a complaint for mail fraud with the USPS. From what I hear, they will investigate the complaint.
 

I'm not going to pursue it. I used to have some loyalty to ebay though and their treatment towards me several times recently has ruined it. I used to think when someone wanted to do a deal outside of ebay that it was not cool because they wouldn't have found me if it weren't for ebay and I would insist on the deal being made through ebay because it was fair. If they want to crap on me though, then heck with them. As soon as something remotely similar comes along I am on their bandwagon. The opportunity is ripe for competition from what I gather.
