Three ring CW bullet? Maybe Misfire?

Found this along a stream in Durham NC. Though it was a 3 ringer but it looks like it has a cap? And the rings are awful close to the top... thinking misfire because it appears the back of the bullet took the brunt... Thoughts anyone? Maybe it's not CW?
