Treaty of Paris 1763

It seems that everything related to Spain and their right or claim to
shipwrecks in the US are tied directly to the Treaty of Paris 1763
although the US was separated from Great Britain with the Declaration
of Independence on July 4th 1776.

Since there was a separation from Great Britain at this time (1776)
why is the Treaty of Paris recognized by the Courts of America and
used in court decisions as follows:

"The Fourth Circuit applied the express abandonment standard to the 1763 Treaty and determined that Spain had not relinquished its rights to LA GALGA. First, although Article XX of the treaty contains "sweeping language of Spain's cession," it never explicitly refers to vessels, warships, shipwrecks, or frigates."

Article XX does include the Bay of Pensacola (Tidal Water) as well as all that
Spain possesses on the continent of North America etc..., including property,
possession and *all* rights, acquired by treaties or otherwise and cedes
and guaranties, in full right, to his Britannick Majesty.

Article XX states:

"XX. In consequence of the restitution stipulated in the preceding article, his Catholick Majesty cedes and guaranties, in full right, to his Britannick Majesty, Florida, with Fort St. Augustin, and the Bay of Pensacola, as well as all that Spain possesses on the continent of North America, to the East or to the South East of the river Mississippi. And, in general, every thing that depends on the said countries and lands, with the sovereignty, property, possession, and all rights, acquired by treaties or otherwise, which the Catholick King and the Crown of Spain have had till now over the said countries, lands, places, and their inhabitants; "

Based on this I think Spain does not have a rightful claim to any shipwrecks in
U.S. territorial waters.

Let's make this thread politically incorrect. Spain should be made to pay for its' past transgressions against humanity..namely, the central Americans/south Americans whose riches they stole and civilizations they plundered, and left them defeated with social diseases. Screw their "claim". This is tantamount to returning Nazi wealth to Germany.
 

ah --may I add -the 1763 treaty was between britain and spain ---traded cuba (which was taken in war by england) back to spain in exchange for florida -- everything in florida and all the rights that to florida that the king enjoyed basically were swapped ---that includes the right to claim the "territorial waters and whats in it" ---the territorial waters of florida (and thus the "imbedded" shipwrecks in it belong to the state according to the Abandoned shipwrecks act) belong to the state of florida according to the us govt--- now the british govy and the spainish govt cooked the books in the La Galra case by saying "OUR" agreement did not include anything about the "shipwrecks"in territorial waters --thus spain retains her rights to the vessels -- (they (britain and spain) issued a "joint statement" stating that) the american courts had no choice but to agree -- if two people make a agreement and they both agrree it means "X" --how can you say it means "y" since after all its "their" agreement so they should know better than anyone else what they agreed to ---now it they disagreed on what it said that would be differant--and thus the US courts would have to "figger" our what it meant legally---
* a much better arguement for spain's loss of "shipwreck" rights could be made using the US Govt's "buying" of florida for $5 million in 1819 from Spain --- the united states paid spain for florida -- directly -- no others involved --so "our" the american govt take of what the agreement means comes into play ---by law the us govt must defend its citizens claims against foerign countries --ie spain--spain (the king and country) ceded florida and all "spanish" rights forever to the USA Govt --that includes the rights to claim "terrirtorail waters" a right used by the spanish -- so spain in effect "gave up" the territorial waters (and thus what was "imbedded" in it the shipwrecks prior to 1819) to the USA-- the federal govt via the abandon ship wreck act states that "imbedded vessels ARE a part of the STATE in which they reside." ---thus florida "owns" these wrecks --- Ivan
