Judge Ochoa has been appointed by the California Judicial Council to oversee all litigation related to suction dredging. It is not unusual procedurally in such a situation for a potential conflict between judicial entities to be consolidated -- in this case in San Bernardino County. This coming Tuesday Judge Ochoa will hear final arguments in regard to the motion for summary judgment. Quite possibly he also will rule from the bench. He may or may not issue an injunction of his own. If he does, it will apply to all counties in California. It may be in favor of the dredging community or against -- we will not know until he rules. But THAT is the ruling that will be final at the superior court level, not the above referenced "news flash" procedural step Judge Ochoa has taken to consolidate these matters as he has been appointed to do.
 

Well let's all hope that Judge Ochoa is an informed person and takes the time to study the FACTS for himself instead of just caving in to the enviro-nuts and their lies. I for one (and I'm sure I'm not alone in this) feel that this issue has been clouded by lies and false science and just want the truth to be heard for once.

Granted, his ruling will not effect me here in Arizona, but I'm pulling for my mining and dredging friends in California.

Oakview i appricate your optimisim but he could have done nothing about this temporary restraining order in Siskiyou County. i don't know whats going on behind close doors so extending the the judgement only means bad news for the dredgers, as for the Bio i read that sometime ago as well, and thought about my buddies that do most the same and hunt too and some vote for the Dems ( sorry folks, but if you know of a Dem that came to the aid of miners in 09 please let me know, and who wrote that crazy as lead ban?)

No offense but I hope you are wrong, I choose to be optimistic until we get the final kick in the groin. PS Dave Mack from the new 49ers sent me a pm this am, and he is of the same mind as you, however he said that they are still using their GTS for underwater mining, and Fish and Game have agreed to honor the Temp Rest Order... The whole thing is weird....

If you look at it from Ochoa's perspective - he will risk his career if he chooses the miners. Lets hope he has integrity AND cojones.
 

Although I live no where near California and currently it does not affect me but could in the near future if things turn out bad for California Prospectors! Is anyone on the prospecting side of this going to be at the hearings and make a show as well as have some experts testify on behalf of the prospector's interests? Many folks here and there talk big stuff when a law or ruling is coming down on them and their' businesses or hobbies but very few actually do something about it! If thousands of full-time and part-time prospectors showed up to the hearing in full force, maybe the Judge would listen to your side of the argument. In any case, showing up in full force would definitely get the media's interest up and Judges, Judicial System and States hate to have them involved and if you can sway any of the media to your' cause, then you should be able to sway more folks to your' side! Just a thought!

As I hear it, the guys in that area have been excellent at attending all the court dates down there, hope they can keep it up due to constant changing of
dates. The Valley Prospectors club and the Temecula Valley Prospectors deserve our thanks as well as any individuals that attend.
