You have to start from scratch. But if you think it would help you, sometimes you can view the closed claim file at BLM, if its not too old.
 

Yup... have to take it from the start because you were not the person(s) that had the claim in the first place. After all this time even they would have to start all over. If they still have the info on file at the BLM, see if you can get a copy of the paperwork and contact the old claim owner and ask why they let it go. If it's a lode claim it may be played out already.
 

Before you claim this 'closed' claim, notice which quarter section it's located.
Now check 'active' claims to see if there are other claims in that same quarter section.
Notice the location date on any claims in that quarter section that are just after the date the 'closed' claim became closed.
What you might find is that someone, just like you, noticed it closed and filed on it already.
Only way to truly know this, is too check the county recorder for that 'closed' claim and look at their location map.
Do the same with any new claims filed at the same time as when the closed claim became closed.
This is how overstaking occurs...not enough research.

Everything in the section is defiantly closed. I am thinking a lot of folks let them go with the dredge ban and all. It seems like the creeks have been worked pretty hard. I am testing a little farther up the bank on some of these to see if it might be worth reclaiming. Thanks for the advice. Just thought it might save some time if you were able to just reopen them.
 

Make sure that the area is still open for mineral entry. Many spots with old claims are now unclaimable. The BLM will usually take your money and then send a notice that the area is closed to mineral entry.

Research a little more or at least call the blm state office and give them coordinates and ask before waisting a lot of time.

Well the JC here has classes on prospecting that are really good. They're given by the president of our club. As far as classes on filing claims go, Clay Diggins is working up a series on just that subject to post here on the forum. I don't know when he will have it finished up and posted though as I haven't heard from him for some time now. He's got a LOT of irons in the fire.

Rdj Sluicer you won't find the California Master Title Plats there. California is special and hasn't finished it's submission to the Government Land Office yet. They are about 73 years behind schedule. :BangHead:

You will have to use California's special version of the MTPs here:

The hardest part about filing a claim is making sure the spot you want is available. After that its simple paperwork....Parking at the state office is a little bit of a pain other than that easy. a last name and serial number if you can get it makes the search at the county easy also.
 

Go to Shasta county tax assesment office and look it up on map,then books and write down all the claims legal description number and THEN go to ez touch screen next door in Recorders office to find out the truth. All claims begin and end there and all annual filings also. Get names of claims,owners info off claim markers as also a great assist as claims are transfered/sold/partners buy in or an amendment was made. LR2000 is merely a VERY rough general info outlet. John

Thanks for the local info John unfortunately I am going to have to sacrifice a week day and go over to Weaverville as the area I am looking at is in Trinity. I am assuming Trinity county pretty much works the same way right?

When you get the serial page it well have all the information you well need to reclaim this claim, including corner post locations, names, addresses, ... Also ask if there are any special assements like road work assements. At one time I almost claimed a claim that had a several thaousand dallar road assement attached. Good luck.. JOHN

That's just not going to work John. The BLM doesn't determine what is a valid claim and closed claims don't mean there is not an active claim there. The BLM serial page does not have corner locations. The BLM only maintains claims files to the nearest 1/2 mile quarter section and even then are often wrong.

Follow Hoser's advice. Go to the LR2000 only for a rough idea and then visit the County Recorder's office for the real deal location recording and maps. Even then you will need to check for new locations on the ground before you can make a claim. Oh yeah - there's that little detail about finding valuable minerals before you can make a claim too.

I was hoping to avoid buying a GPS right now but I guess I am going to have to just suck it up. Thanks for the advice Clay. btw how much valuable mineral are you suppose to find to stake a claim.....
