TOPEKA, Kan. (AP) — Authorities say 25-year-old Kristopher Wenberg of Kansas
was walking along railroad tracks wearing headphones and was hit by a train that he didn't hear approaching behind him — but that he got back up and kept walking.

It is against the law to walk on train tracks and Wenberg would be cited for criminal trespass.

I don't get that.
I always thought in order for it to be criminal, You have to show intent
to cause trouble.
I'm sure if he gets a lawyer, he could probably get him off or at least down to
simple trespass. all he should need to do is prove ignorance,
& that fact he got hit by a train
by walking on the tracks with headphones proves ignorance.
add to that he still hasn't realized if you get hit by a train you get killed :laughing7:
