no markings its about 5/8 inch tall rimfire 3/8 dia or close to that brass im in the prescott az area

It may be a cartridge case (without the bullet), but it's hard to tell. The Henry rimfire had two pins - but your image looks like two small round perforations instead of the rectangular faces of Henry pins.

no they are rectangle , had to get magnifier out but yep rectangle . the center seems to be raised up in the middle between the two rectangle

Without measurements, looking a dual firing pin marks and dome center, I'm guessing 44 Henry. Need more info.
