Found this in a box of petrified wood that came from out West, is it agate? It is almost waxy looking.

That I can't tell you. I'm not sure if anyone can because it is a common mineral; that doesn't mean your specimen is common.

I would personally call it a "Fortification Agate". It fits the description.
