Proof Thomas Beale, Who Had Died, Was The Registrar of Wills In New Orleans, Sep 13, 1820

This is a newspaper dated September 13, 1820. This is the Reg of Wills that died of yellow fever, not Captain Thomas Beale. We still have no death of Captain Thomas Beale, but the death certificate of Captain Thomas Beale died in 1818, witnessed by Samuel William Beale, who was born in 1820 in Baton Rouge.

James Thomas Beale was born in 1820 and died on April 16, 1869, at the age of 49. He is recorded in some documents as Thomas James Beale (TJB), but this appears to be a clerical error, as "Beales" should not be plural. He is buried at Girard Cemetery in New Orleans. Now The Supper Dome!

Is it possible that Captain Thomas Beale is the same Beale mentioned in the Beale Papers? There seems to be a lot of confusion surrounding these individuals in the New Orleans area.

Im curious...if Captain Thomas Beale died in 1818, how do you explain him signing over his property to his son, Thomas Beale Jr in 1819 (per probate records) and having died 2 years before his 2 youngest children were born; James William Beale (1820) and Octavine Beale (1821)?

That's easy
1. The Child ( Samuel William Beale ), who verified Captain Beale's death in September 1818, was not born until 1820.
2. Celest Beale had no proof of the death of Captain Thomas Beale, so she had to manufacture one.
3. It does not say they accepted the Death verification, but it did start an event to happen to prove Thomas Beale Jr. from VA. to be ineligible to have the inheritance of Captain Thomas Beale, as his mom had him out of wedlock.
4. Captain Thomas Beale died, possibly sometime after 1824, for real out west.
5. Thomas Jr from VA died in 1823. His grave site is unknown. Possibly VA
6. Thomas Beale, the Register of Wills, died with yellow fever in 1820 was the event that started everything rolling.
7. James Thomas Beale died in 1869 New Orleans. His name at the time of his death was Thomas James Beale (TJB). There is a clerical error on the grave paperwork showing his last name a Beales, not Beale.

This is simply how the paperwork rolled out. I cannot definitively say that Captain Thomas Beale was the same Captain Thomas Beale associated with the Beale Papers. However, by analyzing the facts and considering all the Thomas Beales who have existed, it appears that this Captain Thomas Beale, who was of the rifleman of New Orleans, is the last man standing. Possibly, there may be another one that pops up that we could research.

The probate/court record for Chloe Delancy vs Celest Beale clearly states that TB Sr transferred his estate to his son, TB Jr, in 1819.
It goes on to state TB Jr was with TB Sr when he died (no mention of year).
It then indicates TB Jr took control and operated his father's estate until TB Jr died in 1823.
That would put TB Srs death before 1823 in New Orleans.

After TB Jrs death in 1823, his mother, Chloe Delancy believed the estate should go to her and the reason for delancy vs Beale. The court sided with Celest Beale.

In 1855, TB Srs youngest son, James William Beale age 35 (born in Jan 1820), filed a death record affidavit indicating his father, Tomas Beale, age 47, departed in September 1818.
If you look at the handwriting, it is not the same as James William Beale's signature indicating the recorder wrote down the information and James only signed.
My opinion is, the recorder wrote down the wrong information because the record clearly states his father TB was from Virginia and a planter which describes TB Sr.
Add the fact James William Beale states he is 35 (1820), at to me...the 1818 date must be wrong.
I might summize James William Beale gave his father's age and clerk subtracted wrong.

At the end of the day, it doesn't matter whether there are 2 or 3 because the records place all 3 TBs in New Orleans at the time the story indicates TB is out west...they can't be in 2 places at once.

I can see how you are looking at it, but there are a lot of squirrely things going on here. There is a possibility that both women were trying to take advantage of the fact that a Thomas Beale had died, and both tried to get the hotel and the plantation. Celest Beale was the daughter of the Governor and had family all over the place that had a lot of pull in the courts. She was a Lawyer trained as a child. The state later actually made laws based on what this woman tried to pull off in court.

Like I said before, this Captain Thomas Beale has not been crossed off my list. Possibly, he is not the guy, but if you factor in the fact that Andrew Jackson himself was his pen pal after the War of 1812. And had a lot to do with the areas Beale had been in and the Adams-Onís Treaty (1819), I begin to think it was not a hunting trip Beale was on. Just the way Beale said he was going hunting the last time in his letters has me wondering. Darn Rabbit! lol. Just looking for good info factoids to be able to cross Captain Belae off my list!

I would wonder if the letters to Beale from Jackson and Jackson to Beale could have been in a secret code, just looking like regular letters.
