No one was saying they could kill a dog they "think" is viscous, you first statement wasn't worded that way, which lead to these laws being posted.That's nice, but nowhere in that legal rambling does it state that you can kill your neighbor's dog because you think it's vicious.
This is the law in most if not all of the states, I thought most everyone knew this or at least they should if they own any dog/s, as these laws apply to ANY dog, not just those dogs deemed most dangerous!!"Nice" post. You are still wrong. But "nice" try.

§ 4-13-18. Destruction of dogs in defense of person or livestock.
Any person may kill any dog that suddenly assaults him or her or any person of his or her family or in his or her company, while the person assaulted is out of the enclosure of the owner or keeper of that dog and any person may kill any dog found out of the enclosure of its owner or keeper, assaulting, wounding, or killing any cattle, sheep, lamb, horse, hog, or fowl, not the property of its owner.

In your case I would think it's the owner of the other dog your dog is acting aggressive towards, but usually there is an injury involved and them reporting it to an LEO before it's "official" .So how is a dog declared vicious ? and who is the person declaring it ?
Many times the vets are closely linked with animal control. An injured dog is presented that requires stitches or surgery, resulting from a dog fight might trigger a report to animal control so they can follow up with the owners. They like coming over and play throw the ball or what ever and he runs to return it. Just seems if another dog shows aggression he responds'
Gare, I’ll start this by saying I am a dog lover 100%, full stop. However, there are situations (individual dogs or breeds) that need to be treated differently. Not to piss off you or others on the site, but 20 years ago if you were my neighbor you wouldn’t be asking this question…..the dog would have disappeared. Even today, if the dog showed aggression towards me/my family/my animals….wouldn't be a conversation. My grandfather had a similar dog 40 yrs ago, was good with grandkids (obviously adults around) but killed any other dog that came on the farm. That dog lived out the last 6-8 yrs of her life in a 6x12 pen because grandpaw wouldn’t let her out (fearing for grandkids and others). Either plan on keeping the dog locked up for the rest of his life, take it to an approved facility who can deal with animals like this, or solve the problem yourself. Yep. I had a bully cross that became too aggressive. Ok with me but thank goodness in the time I had him nobody got hurt.You did that in the original post I believe
Dang it. Some dogs have to ruin things for everyone else. Tort Liability is a real thing. While it would seem the motorcycle was at fault because he should be going slow enough to safely stop if an animal runs out. The insurance on the home paid better.I had a friend that went to answer the door bell to grab a package from the mail man. The family dog snuck out while grabbing the package and ran across the road. There was a motorcyclist coming down the road and swerved to avoid hitting the dog as it ran across the road. The cyclist crashed and broke both legs and pelvis. The cyclist then got a lawyer and sued the dog owner for the limits of liability on his home-owners insurance policy. $300k.
Animals are a liability, no doubt, so be sure you have coverage. Be sure your home policy does not exclude "animal liability".
I disagree that the driver was at fault, how many times have deer darted out in traffic and couldn't be avoided, sometimes it happens so fast you just can't easily avoid them!Dang it.
