Sold a Hallmark Ornament a while back...a few weeks go by and I get this.

The case details:
The buyer says the item doesn't match the description.
The buyer paid on Sep 10, 2014.
The buyer chose "other" as the problem with the item

Additional information:
"Cardinal is not in great condition. The red is worn (showing gold) on both wings, top and bottom of tail, neck, and tummy. Yes; the box, ribbon, packaging, and memory card are fine. But, the cardinal itself is not in "great" condition."

The buyer requested:
A replacement item

Transaction information:
While the buyer's case is open, the funds from this transaction, including the purchase price and shipping, are not available for withdrawal. View PayPal transaction

I respond quickly with this:

Your message to the buyer:
"If you are not pleased with the ornament that is fine...let me know and I will refund you money when the bird is received back. The finish on the ornament isn't complete red. It does have gold bleeding through. If you look at other 2005 ornaments on Ebay and google images you will see they are all the same. Again no issues if you are not happy with it. Please let me know so we can expedite the process."

---------------------------------------------------------------------------------------------------------
They respond with this:

Buyer's message:
"I will love this cardinal, but wish you would have provided a more accurate description. Considering how worn the red is, it was grossly overpriced. I do no want to give you a poor review, but cannot give five stars considering how worn the finish is."
---------------------------------------------------------------------------------------------------------

A month later they escalate they case...two days later its closed in the buyers favor.

I really don't understand the problem...I said I will take a return and there really is nothing wrong with it...but can easily re-sell it for the same amount.

In my opinion they were keeping it.

Sounds, feels and looks like a scam! Sorry this happened to you!
I'm getting ready to do a lot of ebaying! I hope not to run into this problem!
Best of luck!

Yeah, I'm kind of getting a vibe from the last communication that they wanted some money back for positive feedback but said "the heck with it" and offer a refund. They are returning it according to Ebay so hopefully its the same that I sent them though I don't have a good feeling about this transaction.

On another note just list your stuff...I have a love hate with Ebay and my anger usually passes when I sell a lot of things...nature of the beast I guess as far as people trying to scam you though.

Good luck.

I was gonna say at least it was a Hallmark ornament and not a Swarovski or something. But after taking a look at the sold prices for those particular ornaments I will say this instead... Good luck. You will be lucky if you actually do get it back now. You left the ball in their court after you gave no reply to their last (semi-threatening) message. You should have responded back to them after their last communication with... as previously stated, please return the item and I will issue a full refund when it arrives.
Those ornaments are made with that distressed look and gold trim to begin with. I would appeal the case myself if I were you and didn't receive the ornament back. I would assume you have a return tracking number? If not your definitely screwed and you better get on the phone to eBay and start jumping through the proverbial hoops until you get a real live American on the phone and explain/let them review the communication between you two regarding the condition and supposed gold "wear" marks which are part of the design. You better add them to your blocked bidders list too.

They do show that A UPS number was generated but doesn't show as accepted at this point. When it shows as "delivered" the money get refunded by an automated process. My biggest issue is that it has taken so long for this process and I go out of my way to make things right for the buyer. I've just spent the past hour looking for an actual appeal link but to no avail. I guess I will wait until the item comes back and see what the deal is at that point before I start on the phone...as I said before, if its the exact item and condition as sent I will sell it again as it was priced well below others and was in fine shape. It appears to me if Ebay actually read the interaction between us it wouldn't have warranted the case results I received. I just don't wasn't this going against me.

There are too many scum bags on Ebay. They break the sellers gonads all the time.
Anyone see the new PayPal Policy updates?

• We're increasing the time for buyers to file merchandise disputes (Item Not Received and Significantly Not as Described) from 45 days to 180 days.
• We're extending buyer protection to include item not received claims for custom made products.
• Because PayPal Seller Protection and Buyer Protection policies may vary from country to country, we're adding language to clarify which country's policy applies when a seller makes a sale to a buyer outside of the U.S.

You can't appeal it until it's final. I don't think they read the conversations between you and the buyer until you start complaining and even then you usually have to force the issue with the first "call center" flunkie and demand to speak to a supervisor (in the US). One that can actually comprehend the English language instead of just being able to read and speak it.

Well good news for me.

I was told by customer service that I had to wait 10 days and they would close the case if the item still didn't show as shipped.

Today, the 11th day I called customer service and went through the transaction again and was told that they will close it in my favor...great.

Four hours pass and it still showed as an open case and the money still held in PayPal.

Just called back...again told the whole transaction again and the woman on the phone answered just as robotic as the first. I told her that's exactly what the prior call taker told me and it still shows as open. I was told she will make sure its done this time.

Just checked...case is no longer open...closed in my favor and the funds released.
