went to an old factory that was demolished this morning.but i went there last night and jumped the fence last night and had a great time.the day before i asked if a could md the site and the answer was no.i thought what the hell and went back at night.got there about 2am but to my surprize there was 5 others already mding and looking for relics.i didn't know these people but there cool.the old factory was a chinese store first [1864 TO 1875] and then a foundry call higgs and son till 1940 when it was a sort of buck house for u.s troops station here till the end of the war.then a storage shed for acouple of years then empty for the last 40 years.this factory was part of the american quarter as it was known.many american owned factorys here.none remain to day.well i got coins and a large clay bowl .wash bowl i think and some coins.

Hey don't we all have a bit of PIRATE in us? Or are we happy with just digging trash? No, everyone admit it or not wants a bit of booty, and gold ring or a gold coin to show at the end of it all! I say Tinpan had enough judgement when and when not to jump a fence.
Nice coins! ;) ;D :D These times will be the ones you look back at and remember and laugh about!

HH and don't feel shy about sharing no matter how some may feel we all enjoy a good story and even a good chase if it come to that LOL !

( Pirates life for me!!! Gigi )

Re: they wouldn't let me md, so i jumped thr fence after they left.it was great pics

I agree with SWR, BK, Slowsweeper and The Seeker. I don't want to judge anyone, but if I am specifically told NO, than NO it is. The finds were very nice, but for the value of a ring and some obviously really beat up coins, is it worth the bad image it gives all of us and the hobby we all love? I don't think so, and I believe most will agree. Believe me, I understand WANTING to do it, and can't honestly say I haven't been tempted to do the same, but unless the "treasure" you seek from that spot is a pirate chest full of gold worth millions, is the value of the finds worth the risk to your own safety and the image of the hobby? Apply your obvious creativity and effort to researching for good, legal hunting grounds, and the finds will be just as nice. HH!

Well...Well... Not sure what really the atmosphere was... It looks like to me that they had to say the official NO, but then if at night someone comes in and does a little detecting and got hurt, they would be covered. If they had said yes go right ahead, then you fell and broke your neck..well, we all know what might happen!!! I mean it was being torn down. Uh ...The owner probably would want to see what you found as long as he was covered from any law suits! Here in Japan it is kind of easy going..Only place I have had any problem was on a beach and come to find out I was in the right..Some guy with a seaweed net on the bottom of the beach area, but it was a public area and anyone can do what they want. Anyway, best of luck...I would of been there with you I think, Night Raider!! if it was how I think it was! :)
Everyone here is right, It was your call on what you thought was right...yada...yada...

When you guys are bashing him for potentially ruining the hobby for the rest of us... what do you think about the guys over in Germany and other European countries that are posting old finds on here even though they aren't allowed to detect there

The 1992 law on the search for, and preservation of antiquities, covers all objects belonging to the ancient period, early Christianity and the Middle Ages.

Excavation requires a licence and work may not be carried out, without permission, near an antiquity in such a way as to affect it directly or indirectly. All accidental discoveries must be reported. Rewards are made equal to 50% of value if found on public land and 100% if on private land.

Although the 1932 Act does not refer to metal detectors, any items found by its use are covered by the Act.

bscofield6...I am reading your words, but not understanding what it has do with someone jumping a fence and detecting after they were told not too :-\

He openly admitting to doing something that he was told not to (jumping the fence) and then posting about it here on the forums.

Then there are several people here on the forums that are from Germany and they post their finds all of the time, even though it isn't legal to do so in their county, as they have been told no by the Government. They are breaking the law just like this guy was, but nobody gives them a hard time about it, so why give him a hard time?

Re: they wouldn't let me md, so i jumped thr fence after they left.it was great pics

Tinpan,

You know I'm a little confused about you. Didn't you find some ancient relics and re-bury them because it was against "your laws" to retrieve or posess them. No judgement here, I'm just a hobbiest MD'r and got more sites to dig without worry of trespass or permission than I can shake a stick at!

You also seemed offended by my comment of " having bragging rights " cause you had pictures of the relics.

Well now your bragging about dectecting areas you say you were denied permission to detect. Man-- think about what what your saying, this is an international forum.

Answer: "Private Property is accessible by permission"----check out the laws on this one, it applies to US and Europe, and most all the free countries! Government property is almost always off limits, anywhere in the world, unless you can get the proper permission as allowed by law!

GOOD SHOW!

If I were in the same boat i would likely have done the same! Congratulations on the good finds and many more.

thanks for opinions on the post and for the private replys.smartin thats a point , private messages are excactly that private and you had no right to post my private message to you.the native title act is an act of parliament thus become a law and local bi-laws are not and maynot stand up in a court of law.i respect other opinions and always use good manners when replying its a shame that some donot.

Tinpan,
Next time just don't ask.
Don't ask and especially don't tell.
If you keep those parts to yourself, you're less likely to be chastised by the "do-gooders" on here.
They mean well and respect the law (as we know it here) as we all should, but everyone makes their own decisions to go or no go.

According to Jeff, you weren't even trespassing because there wasn't even a building there. You weren't asked to leave either!

"TRESPASSING means refusing to leave when asked,
or Entering a Building without Legal right"

Cool. Keep it up and find some more good stuff!

Re: they wouldn't let me md, so i jumped thr fence after they left.it was great pics

Looks to be about 50 -50 on this one.... I'm of the same mind as an earlier poster. I wouldn't have done the same thing after being told no either. But thats just me. The nod- nod wink-wink I don't see nothing answer, I will pick up on and respect sometimes.

Here in the states, private property rights are very important to me, as is my hobby. I will respect them both. If as you say it was public property, then whatever the laws are in your area would seem to apply.

Not to throw this into anyones face either but I always try and follow it and weigh it with the current laws. JMO since it's there for a reason. No sense in giving gov. more firewood than they already have.

Very interesting views, HH Art...

Re: they wouldn't let me md, so i jumped thr fence after they left.it was great pics

This is the behavior that gets us a bad name and restricts our access to places to detect! No means NO. >:(

Re: they wouldn't let me md, so i jumped thr fence after they left.it was great

Nice finds Tinpan but I think you are dancing on the edge but hey, it's doomed to be a parking lot. ABOUT GERMANY, ATLEAST IN MY DEFENSE: I have a permit or license as indicated in the quoted regulation and permission from the land owners in the state of Bavaria Germany. Every site I detect has 4-5 permission slips; Town Hall, County, Archaeology Dept, Land Owner and if the owner is renting the land, the renter as well. I have a permit for a piece of land with 27 owners, I crossed it of my list, LOL! The German law has been interpreted to me differently depending on which town I have asked. Through talking to many officials about Article 7, I have come up with this, a person can not detect a historical site or near a site without a permit, near is defined as 50 meters, if there are no historical sites involved, then you only have to ask the land owner. They will not approve a permit around historical sites for a common detectorist or allow you to help with an Archaeological dig using a detector in Bavaria. There are a few exceptions though, I have legally detected around a castle ruin built in 1107. I can say I am as legal as I can possibly be and it often comes down to good judgment. I also have to show the Archaeology dept. my finds when or before the permit expires or they will not renew it and by the way, the permit is free, just a hassle to get. HH, Mike

Re: they wouldn't let me md, so i jumped thr fence after they left.it was great pics

Way to go on the nice finds Tinpan.
im not going to say i havent done the same thing also, trespass that is.
cause i have numerous times when i was really nice to people and still got shit on ( a no answer in other words )
yes there are other places to detect people, but sometimes we let our minds wonder a bit and do other things.
Im not sure everyone on this website is human or not, but for those of us are, lets respect everyone on here and their decisions.
i know several people who has left our commuity because people doubted themor was really rude towards them.
WE ALL NEED TO STICK TOGETHER, OK !!!!!!
